Apparently, Brandy was not using her mobile at the time of the accident. Anyway, I came across this article today in the british news paper, The Daily Mail. .

Drivers who kill while on the phone could be spared jail



Killer drivers who run down their victims while talking on a mobile phone should escape jail, the government's sentencing advisers declared yesterday.

They said any driver who takes a life because of carelessness or selfishness should get no more than a 'community' punishment.

Those who kill while driving without a licence, disqualified or uninsured will also be spared prison under the proposed sentencing regime.

The rules, put forward by the Home Office-run Sentencing Advisory Panel, would operate under laws on killer drivers coming into force later this year.
They bring in the offence of causing death by careless driving. This is meant to ensure those whose driving falls short of dangerous driving will still have their crimes treated more seriously in court.

The offence, which covers using a mobile, speeding, eating, drinking or applying make-up at the wheel, carries a maximum sentence of five years.

Yesterday motoring organisations and victims' groups accused the panel of undermining Parliament's intentions.
Road safety charity Brake called the proposals 'horrifying' and added: 'This will restore the current situation in which bereaved families get no justice and drivers who have killed get no punishment.'

The RAC Foundation said: 'This sentencing pattern may leave families still feeling that the courts have not recognised their loss.'

The Sentencing Advisory Panel - which reports to the Sentencing Guidelines Council led by Lord Chief Justice Lord Phillips - published its plans in a consultation paper yesterday.
If endorsed by the council, courts are likely to start using the guidelines by the end of the year.

The panel said it recognised that Parliament had intended to increase sentences in last year's Road Safety Act.
But it insisted that the courts must also recognise that careless drivers carry a low degree of guilt.

As a result, it said that in a typical case a driver guilty of the new offence should get a community sentence.
If there is an aggravating factor - for example a driver using a mobile while overtaking carelessly - the punishment may still not go over the 'custody threshold', the panel said.

Its advice said: 'The sentences we are proposing may be criticised by the deceased's family and others.

'The sentence will inevitably seem low if compared only with the magnitude of harm done by the offender.'

It added: 'A sentencer may need to take account of the fact that an offender is guilty of no more than a momentary lack of attention, albeit with devastating consequences.'
The proposals will infuriate ministers pressing for tougher punishments. This week Transport Minister Douglas Alexander introduced penalty points and £60 fines for those caught using a mobile while driving.
 
Brandy was definitely at fault because her rear-ending the vehicle is what started the chain of events that led to this womans death.I don't think she will get any jail time but I do think she'll have to face charges. Her celebrity status wouldn't mean jack if she had been intoxicated,high on drugs etc,she would have been arrested on the spot.She has also opened herself up to a wrongful death case that could put a dent in her pocketbook.

I feel bad for Brandy and the family who lost their loved one.Brandy will carry this burden the rest of her life.

Dah, of course it was an accident, unfortuantely a accident due to someone's failure to keep on eye on what is going on in front of them on the highway!

Did she have proper distance between her car and the next car -everyone knows you should space yourself between you and the next car depending on how fast you are going, so you enough time to stop and not rear-end someone in front of you.


What about doing 20 miles over the limiit, was this an accident too?

Was it, seems more like neglience - no mechanical failure to blame!!

So sad, I do feel for Brandy but not as much as I do for the family who lost of loved one - so wrong!!!
 
If her vehicle didn't have any plates on it yet, wouldn't it be illegal for her to be driving on the street anyway?

She probably had temp plates, I really don't think will be a problem there....I'm sure she had insurance prior to taking the vehicle off the lot of the dealership....I just hope she has proper limits of liability on her insurance!!!
 
:?: I have a legal question from all of this. If a noncelebrity person is involved in a fatal or serious accident where no drugs or drinking was involved are they arrested?

My friend George was hit by a bus a loooong time ago when we were like 8. He ran out into traffic (chasing the ice cream man) and the bus driver was going slightly over the speed limit (like 40 instead of 30). It was a horrific accident, but I don't remember the bus driver being arrested. I was there right after it happened because we lived on the same block, so I think I would remember if she was arrested. Are you only arrested if it's like 100% your fault? What if the person was jaywalking between two cars & you hit them (or something where it would be that person's fault)

Anyway, I'm just curious. OT I know.
I'm not a lawyer, but I imagine it would depend on the circumstances. If it isn't immediately apparent a crime occurred the police wouldn't arrest the person at the scene. But if their investigation uncovers a crime and the District Attorney decides to file charges, then they would obtain an arrest warrant for the person.
 
My husband's uncle was struck by a car that ran a yellow light after that car was struck by a car that began to drive to early when the driver mistook a green arrow in the left turning lane for a green light to proceed in the middle lane of traffic. No drugs or alcohol were involved. Just stupidity. The car that was struck spun out of control onto a sidewalk where my husband's uncle was standing. He was struck so hard he was sent flying back against the side of the building behind the sidewalk where he was standing. He had a crushed pelvis and a collapsed lung. He died a few hours later at the hospital. He was 73 at the time and had survived open heart surgery less than two years before.

No criminal charges were filed against either of the drivers involved. The family received a settlement from one of the drivers' insurance company. Although I feel someone should have gone to jail, at least his widow (a 75 year old woman living off of Social Security) will not have to worry about paying the bills. The car that struck him was driven by a woman with a suspended license and no insurance.

The accident occurred almost three years ago. My husband's uncle is dead. His family was devastated beyond words, and these morons who had no business driving and caused his death were never punished. Why?
 
I know they say you should never admit fault when you get into an accident. Heck, it even says that on my auto insurance card. However, how can you not feel like just breaking down and wanting to immediately take responsibility when you hit someone the way Brandy did? I've always been the type to admit when I did wrong and take the consequences like an adult. I think I would have a heck of a time keeping my mouth shut.

I've avoided this topic because it disturbs me so but I feel compelled to answer... 7 years ago, I was a passenger in a car that struck & killed a person. Just to give you a scenario.. A couple of us were coming back from dinner. The driver had not a single drink so that question is out of the way. We had to take a short 10 minute interstate drive to our exit. We stopped at the light at the top of ramp. When it turned green, we proceeded down the ramp & we were in the inside lane right next to another car. We were just approaching an area of gas stations & restaurants that you usually see next an interstate exit however it was not a "streetlight" lighted area as I stated before, it was on an exit ramp. Out of NOWHERE, 2 men jumped in front of our car. Apparently, they had been eating at one of the restaurants & tried to run across a 4 lane interstate exchange at 8 in the evening to get back to their hotel. They ran in front of the car beside us in the outside lane & just stopped in front of us. Apparently they didn't see our car in the inside lane or I must say, as details surfaced, it's quite possible they had been drinking. Of course it happened so quickly, we never saw them either. We were only going maybe 30 mph. Like I said, we had JUST stopped at the top of the ramp & were slowly gaining speed. One man died & one survived. There was a stoplight not 50 feet down where they could have crossed safely.

Even though I wasn't the driver, it does bother me to this day. We, in the car, did NOTHING wrong. This was a case of the pedestrian's actions causing their fate. My friend got a letter from the man's daughter basically calling her a murderer & hoping the accident haunted her for life. While I sympathize with the family, that was uncalled for. No suit was ever brought against my friend & if there was, for what?! My friend went to the police station & volutarily gave a breathilizer test- which was 0. Of course there was a standard investigation & no charges were filed.

In her case, I think Brandy just wasn't paying attention. That was her fault but it was an accident. There will be some reprocussions for her & I suspect the family will file a lawsuit.

Just to give you a perspective from someone who's been there when the driver didn't do anything wrong & wasn't at fault. It's just a bad, bad thing to happen to anyone.
 
It is unfortuante, but she should have been responsible enough to pay attention to what was going on in front of her while driving down the expressway. THERE IS NO EXCUSE!!!!

I don't know about respecting her privacy in all of this, just b/c someone is FAMOUS doesn't call for shall I say, "special treatment".

I'm sorry, it is very unforuante don't get me wrong, but I could NEVER deal with knowing I was responsible for ENDING SOMEONE ELSES LIFE DUE TO MY NEGLIGENCE!!!!

Totally agree. If I was the victims family then I would have no sympathy whatsoever for Brandy but I would be very angry. I sincerley hope that she receives punishment for this. It was totally irresponsible and downright dangerous of her.
 
sad. and she'll get a slap on the wrist and probation for 10 years. but wait! isn't she like a has been now? no records? no shows? hmmm, maybe she will serve some time, as she should.
