Wow, I've been following this story on Eurweb.com for the past few days. It's very unfortunate and my prayers to all involved. Especially to the family of the victims. This all reminds me of when she was on Punk'd and how she was freakin' out when the cop (acted as though he) didn't know who she was. That was over nothin' and she had a fit. She must be suicidal right about now. And I hate to say it, but I'm with Roo. I wonder if she was on her mobile. I see and have almost been involved in accidents with idiots talkin' on their handhelds when they should be payin' attention to the road.
 
I heard today on the news she was one her cell phone. Guess records could prove whether she was or not.
AS a driver you are legally responsible to have your car under control at all times, no momentary lack of concentration, no lack of judgement.
It is a horrible thing that happened. But she gets no special treatment cause she can sing well. Thank God our laws are set up this way.

I defy anyone to tell me that they have never been distracted, drifted off into a daydream (maybe thinking, fleetingly, about a bag they want to buy?!), or made a mistake whilst driving.

Most of us are just lucky that it hasn't happened at the wrong time.....yet.

If people should be jailed for making a mistake, or for suffering a momentary lapse in concentration; then we should all be in jail.
 
My husband's uncle was struck by a car that ran a yellow light after that car was struck by a car that began to drive to early when the driver mistook a green arrow in the left turning lane for a green light to proceed in the middle lane of traffic. No drugs or alcohol were involved. Just stupidity. The car that was struck spun out of control onto a sidewalk where my husband's uncle was standing. He was struck so hard he was sent flying back against the side of the building behind the sidewalk where he was standing. He had a crushed pelvis and a collapsed lung. He died a few hours later at the hospital. He was 73 at the time and had survived open heart surgery less than two years before.

No criminal charges were filed against either of the drivers involved. The family received a settlement from one of the drivers' insurance company. Although I feel someone should have gone to jail, at least his widow (a 75 year old woman living off of Social Security) will not have to worry about paying the bills. The car that struck him was driven by a woman with a suspended license and no insurance.

The accident occurred almost three years ago. My husband's uncle is dead. His family was devastated beyond words, and these morons who had no business driving and caused his death were never punished. Why?

I'm so sorry for you and your husband and his family! I can totally relate to that as a loved one of mine was killed by this type of a situation only it took place in a residential area and the circumstances were a bit different! My family is still dealing with the loss.

I do feel sorry for Brandy, I'm sure she did not mean to kill anyone and it is unfortunate because it will affect her for the rest of her life! But I feel mostly sorry for the family that lost their loved one! Brandy will have to suffer the concequences as she is the responsible party, I'm not sure if jail time is the right punishment though! That will be up to the police and the courts to decide! I think that most of us take driving for granted (I know that I have in the past, I now try to be even more careful) and don't realize that it can be extremely dangerous and we should always proceed with caution! I think that if most people were more aware of this, many accidents could be avoided!

I'm sorry, I've read some of the previous posts and I can't get with this "it was an accident" thing. It almost sounds like many think Brandy should get off with a slap on the wrist. I remember learning to drive and being told that you should always leave enough space b'twn you and the car in front of you. I can see if the woman in front of Brandy did something stupid like rapidly changing lanes and failing to signal and that was the cause of the accident. I was involved in an accident like that and the idiot had to pay my hubby's friend, who was driving. Fortunately, no one was hurt. I know Brandy must feel horrible, but you can't get lax behind the wheel. Sorry. You take out one of my family members and I'll damned sure see to it that you pay. If Brandy was the victim, I can imagine what would be said about the person at fault. Anywho, I'll just watch this story as if unfolds. This is just another story that reminds me not to take life for granted and that no one's promised tomorrow.

I agree that most of our mistakes whilst driving haven't taken a life, thank God, but that is because we have been lucky, not because we are perfect.

As I say, if she was doing anything illegal (speeding, tailgating, talking on the phone, eating etc.) then she should be jailed.

But how can one jail someone for doing something no worse than one has done oneself, just because they have done it in the wrong place at the wrong time (assuming that that is the case, in this instance [and who knows at this stage?]) and caused a fatality?

If one does that, one is not jailing someone for their intentions, or even their actions; one is jailing them for being unlucky.

Which, I'm sure you can see, is illogical?

With all due respect, who said anything about anyone being perfect? As far as I'm concerned, the only perfect person to walk the earth was Jesus. No one before or since can even hold a candle.

I do agree with your comment about if she was doin' anything illegal. Yup, she should be jailed. But, even if it had nothing to do with any of those things and she just took her eyes off the road for a split second, I do not think she should just be let go with a slap on the wrist!
 
I think what previous posters meant, when they stated "it was an accident" they mean this was not a premeditated murder. she did not leave her home, to intentionally kill anyone.

Nah, I'm SURE Brandy didn't intend to kill anyone, ever. It is unfortunate. My prayers go out to both the family of the deceased AND Brandy. I'm sure this is weighing heavily on her mind. But, from what comments I've read, it's almost like what's bein' said is it's an accident, like Brandy shouldn't have to pay for her irresponsibility on the road. I don't think she should get the chair or anything, but she's gotta pay for her negligence.

I also know that not everybody's gonna agree with me. I'm just statin' how I feel about the situation. I just can't help thinkin', what if that were a friend or family member of mine. I'm also thinkin' what if I was the one behind the wheel and caused the death of someone. I'd have to take whatever punishment is dealt. I wouldn't expect to get off lightly cos it was an accident.
 
Honestly, this analogy is getting a bit old. I think that when it really is an accident, despite how careless the person may have been, NO one would want to see someone serve jail time. Food service worker or not. I think this whole thing is sad. And I can understand her asking people to respect the privacy of those involved. Privacy is of the utmost importance when a family is grieving. I don't think she necessarily was just asking for privacy for herself. I think she meant it as well, if not more so for the other parties involved.

Well, personally there are a lot of things about the system that I would change, if it were up to me, but my comment was not really intended as an expression of support for imprisoning Brandy, or an indication of how I believe things should be, but rather a remark about the way things are.

I think maybe where we disagree is your contention that "no one" would wish to see jail time for a food service worker who caused the death of a celebrity. It is a fact that people with little or no resources are more likely to receive - and serve - harsher sentences for any and everything, from simple possession of a controlled substance to the most serious and violent of crimes, and while there are people who work tirelessly to combat this, it continues to be the norm, enjoying enough acceptance by the majority of the mainstream population so that it does continue to be the norm.

As so often happens, this touches on a variety of very large topics that would be more appropriate for a different forum than this one, and of course with an interest have the option of looking into subjects from the "corrections industry" to efforts like the Innocence Project, to, as chloehandbags has mentioned, the safety factors of different automobile styles!

But her momentary lapse in concentration, her mistake KILLED someone. Someone is DEAD cause of her actions.

The driving laws state here in the USA ( go look it up, it is true for every state) if you are driving a car YOU are responsible at all times to keep your car under control. This goes for food service workers, celebrities, & eveyone else.

I understand everyone's point of view in this situation. Naturally friends and family and anyone who has had this happen to a friend or family member will think she deserves a long jail sentence. Her friends or family, or anyone who has been on the other side of this situation will think she deserves a break, and that it was an accident, bad luck, unfortunate.

That is what it is, unfortunate. She certainly didn't mean to kill someone, and yet she did, someone lost their life because of her, and there are repercussions. I can't safely form an opinion on this without knowing details because its a grey area.
