Yes, schientist, I agree with you. Ebay dispute's response doesn't sound like they are going to be much faster than if I had done a Paypal dispute.

However, you posted that PP advised you to file w/ Ebay, so I don't think you had much choice. PP is no faster, they also give a seller 10 days to respond. A PITA either way!;)
 
Just saw this thread. Goodluck tuxedo. I went through the same thing when I bought a beat up Gucci hobo thats listed NWOT. I won though and was refunded the money minus the shipping fees. I honestly dont get why we wont be refunded shipping fees since if in the first place the seller did not lie about the items condition, we would not file a dispute right? IMO, seller even has to pay up for RETURN SHIPPING given all this hassle.
 
Do not respond to your seller through private email.....only use the Ebay email system as they is what they look at and count in a dispute. Just won a case with Ebay and that is exactly what they told me.

Glad to hear you called Ebay as that's much faster than email .....plus you can state your case much better with a live person who will also have questions you can answer on the spot.

I asked for a FULL refund for the item and the initial shipping fees but was required to pay for shipping fees to return the item which I sent back with tracking and signature required.

Ebay is working much faster these days on settling cases and you seem to definitely have a good one. Yes, it's hard to wait those 7 days but if you did a charge back it would take a lot longer.

You didn't get your original shipping fees back? I got mine, but I had to pay the return shipping. I totally agree that seller should have to pay return shipping as well when it was their error, however I've learned to suck it up since that's just one of the downsides to purchasing on Ebay.

I went through the same thing with a bal about 2 months ago. It was in horrible condition and it too had that wet icky feel, I know exactly what you mean. I did the exact same thing as you are doing. The seller at first said she didn't have the money and that I;d have to wait. Ebay had told me to send the bag back and so I did. She put it back up on ebay and sold it and returned my money. I don't know why they told me to return but it did work out. I'm sure that you will get your money back, it's just stressful having to wait. It's pretty obvious from the pics that the damage was not just recently done, that looks like it had been ridden hard and put away wet! Just keep every bit of correspondence and be very professional in your emails. I agree your seller sounds like a wacko, she keeps changing her story. I think it's easier to get your money back on a SNAD then a fake. Hang in there!!!!

muchiko19, redskater & merrydish, Thank you for sharing your stories, advice, and support! :D Merrydish, that's REALLY GOOD to know that when you won your Ebay case they said they basically just look at the Ebay messages. I've heard that tip from many other tpfers here, but your experience further confirms it. I think my Ebay messages are clear and express that the bag was misrepresented, and because her track record has been to be largely non-responsive by Ebay messages, I do hope things do work out. :s
Redskater, I guess it's common for sellers to claim they have no $, so that they can use it as an excuse not to provide a refund.

I'm curious though, when Ebay tells you to send the bag back, do they monitoring the process to make sure that the buyer gets a full refund from the seller (after seller receives the bag)? Do they make sure you get it in a timely manner?

i just read through this whole thing. I recommend you not even contact or reply to her at all. she continues to say she will pay you but can't pay you now, etc. however that is not your problem. paypal will reduce her acct to a negative $800 and anytime she gets a sale it'll go toward that negative until paid back. you, however, will get your $800 in full at time of proof of return (def insure and use signature confirmation). So, her going on about needing time to get the money, needing to sell more to get the money, her vet bills, etc. None of that is your problem or anything you need to discuss with her. You will get the money in full if deemed by paypal and then it's her problem to get her negative paypal balance up to paid.

also, she is accusing you of damaging the bag. that damage is a result of wear, obviously, not someone slashing a bag with a knife or anything. it is worn down and that is why it's ripped, so her claim is just bogus, and anyone looking at the pics can see that.


for the most part, i'm fairly certain ebay will side with you, so no reason really to engage her at this point. and any and all messages sent privately, i'd delete without reply.
 
Oh, that's great to hear! Because all this time, when she's been writing using her private email account to mine, I use to be very responsive. But starting yesterday, after consulting with fellow tpfers who supported me and gave me encouragement to open an Ebay dispute and kindly "walked" me through the process, I told her that if she wants to communicate with me, to please do so through Ebay messages. Seller still choose not to use Ebay messages, and instead she continued to send me private email messages about her money situation, how if I want a refund I have to wait til she sells the bag, her parameters for what amount of $ I'd get back, her vet bills, etc.

I've now learned to just ignore those messages, but part of me was wondering if it'd hurt my chances of getting a refund if I was now ignoring her private emails.

they told you to return it so that you can get your money back. the only way to get a refund is to return the item to the seller. you can't get a refund and also keep the item. unless it's a counterfeit, which they may ask a buyer to destroy or return to paypal, they will require a return of the item to the seller.
 
^^^ I know that I would have to return it, what I meant is why they told me to do that immediately without waiting to see if the seller would just refund the money. They have asked the op to wait before sending back the bag, but they didn't do that with me.

I too have been in your shoes a few times. :tdown: I think it is one of the worst feelings in the world. :shucks: Not only are you let down by the exciting feeling to win a great new to you bag...it turns out to be NOT what you were expecting .. :wtf:.now this and her :rolleyes:...No worries,ebay WILL side in your faovr.Have faith....ITA with the other girls too you DO NOT have to reply to her emails off ebay...I would NOT even reply.When this is going on ebay is able and does access yoru messages through ebay ...so not on ebay messages..... ,IGNORE...No need to get yourself more upset due to her money problems.ect ect ect .....sending you good vibes!!!!!!!!!!!!!!!!!!!!!! :flowers::hugs:

I know Tux....it is a HORRIBLE moment.Buying a bag is sooo enjoyable and fun--- most of the time----.Except when you deal with this kind of seller,just wrong on SOOOOO many levels.I know and feel your pain you are NOT alone.Keep up the happy thoughts :tup: soon this will just be a bad memory :smile1: Sending MANY good vibes.... :hugs:
