you might already know this tuxedosam but make sure that,if you send the bag, you send it with signature confirmation of delivery so she cannot claim that she never received. you'll also need a tracking number to prove to ebay/PP that you did send the bag.
keep all her emails,just in case!
 
Tuxedosam it's really important that you only use Ebay email when corresponding with anybody on Ebay. When I won my case recently Ebay specifically asked me if I used their system to email the seller and they even looked at those emails before refunding my money on the spot.

And, it's vital to protect yourself when returning merchandise as Ebay/Paypal and credit cards want a tracking number plus signature confirmation. That gives you the proof you need and takes it out of the realm of "he said, she said" which is meaningless.

This seller will give you every excuse in the book and I think will continue to do so. Next thing she'll need a new roof, blah, blah, blah. Don't fall for this.

Lots of us know what it's like waiting for Ebay/Paypal to make a decision....but they do in the timeframe they specify. So hang in there. I'm rooting for you!
 
I just read through your thread, I'm so sorry this has happened to you. I can't imagine waiting for a bag to arrive and then finding it damaged and misrepresented, how disappointing!

As so many others have said, do not respond to her private emails. She is using private email so ebay can't track or record her communication with you. Not communicating with her through private email, not responding to her private emails, is exactly the right thing to do and will in no way harm your chances of getting a refund! Be sure to save her private emails though, so you have added proof if ebay needs it. I learned the hard way not to communicate through private email and use ebay's email system only!

Again, I'm so sorry this happened to you. It's really frustrating.Good luck with your refund and hang in there!
 
Thanks for the SMART tips, pukasonqo, merrydish, and Nordy's girl!! I think that you all are right, in that the seller is trying to use private emails so that they aren't trackable with ebay (especially since her private emails are rude and dismissive, while her few ebay messages were trying to sing a different tune). Because why else would a seller be so persistent with using her private email?? (plus, before I bought the bag, she was very attentive with answering my questions by using ebay messaging (questions such as whether the bag had a rip/tear. It's only after that I received the bag and noticed faults all these faults with it that she's become quiet on ebay messaging and suddenly very active with private emailing.)

So, I'm currently waiting, but when I am asked to send the bag back (which I hope I am) I should be sure to have just two things?
1) a tracking number &
2) signature confirmation

Do I also need to insure it?
Also, do I take pics of the bag in the condition that it's in the day I send it, in case she pleads that it's even more ruined?? :confused1:
 
You need to have insurance and signature confirmation (this is your tracking). It wouldn't hurt to take pics beforehand and just have them on stand by in case the issue comes up.

Tuxedosam, you should take every precaution when you are asked by Ebay/Paypal to return the bag. You already know you should get a tracking number and signature confirmation. Yes, I think you should take out insurance because as the sender you are responsible for the bag getting back to the seller. I's worth the few extra bucks and I always do these 3 things.

Plus, it's a good idea to take photos of the bag, as you mentioned, as you never know what the seller will claim. On the few chargebacks I've done through AMEX they have asked for photos and you never know if Ebay/Paypal will want them.

Be sure you have let Ebay/Paypal know you will return the bag once they tell you to do so. You don't want to lose your case on this technicality.

Take every precaution and you will be fine. Rooting for you!!!

Agree agree agree!! Spending $20 on your shipping costs may seem like a lot, but ensuring that you're getting hundreds of $ back hopefully would make it worth it!
 
sorry you are in the middle of this dispute...sounds like you will have no trouble winning in the end though...take photos and keep a record of all the emails she has sent you...she sure sounds dodgy to me...even if you think some of these things sound excessive do them anyway...some people just have no conscience and should not be trusted.

She clearly stated in her original listing the item was in good, great and even excellent condition which we can all see is absolute rubbish...

now sit back , try think about nice things and try to stop stressing...PP and Ebay are taking control and will handle madam mouldy-b-bag.
 
I just read through this whole thread and I can't believe the gall of the seller! What part of her vet bills is any of your business? I totally agree with only responding through the ebay system which I see you have been. (Aren't the ladies here wonderful with their advice?)
Before you send it back be sure to take a gazillion pics. Not only of the bag but also of the insurance numbers, tracking, and everything else that's on the box. I would also suggest that you take care to package it so the seller can't somehow claim that it got destroyed when you shipped it back to her.

Today is Day 7 of the open dispute, and I received a new message from Ebay! :nuts: They wrote:

Thank you for reaching out to us regarding the issue with your item. We
are providing you with a pre-paid label to return the item directly to
the seller.

The label should be used within the next week. Click on the link below
to print the label from home. A tracking number and detailed
instructions for drop off and pick-up of your item are also included
with the label. For your convenience, this label allows you to use UPS
or USPS (United States Postal Service) to ship your package.


So I'm going to now take lots of pics and then I'll ship it out. I was thinking of doing it by UPS with signature confirmation, tracking, full insurance. Whaddya think? :smile1:

I also called Ebay today to follow up and ask about how this is all going to work. They said that I should send the item back to the seller. Then call Ebay once the item arrives to the seller (I will know via the tracking number). Then Ebay will give the seller 3 days to give me a FULL refund. If she doesn't after 3 days, then Ebay will provide me with a FULL refund,"on behalf of the seller"! And they will charge the seller that refund amount. (I suppose it will show on her monthly Ebay bill??? )

I know that I did not get my money back yet, but I'm so excited!

However you wish to ship this is a YES... insure, ONLINE tracking & sig confirm, even if you have to pay extra to add a service to the mailing.
There HAVE been posts by other members stating that the ebay prepaid label works best w/ UPS & that if taken to USPS, there is no online tracking/sig confrim/insure. SO... whichever service will provide INS, and ONLINE tracking/sig confirm.

When I had to return a package to a seller Ebay emailed me a "pre-paid" label. However, it did not include tracking and signature confirmation. When I took it to UPS they told me I could NOT add on those things and if I wanted them they would have to print an entirely new label.......meaning that I would end up paying the entire cost of return shipping. Since I wanted to win my case I paid for the whole thing.

So, be sure when you ship that you specifically ask the carrier if the label you got covers tracking and signature confirmation. Take nothing for granted.

i don't know how US mailing services work but as everyone had said: tracking,insurance and signature confirmation are a must. you don't want the seller to claim that you didn't send her the bag.
