I still plan on filing a lawsuit against paypal. I am meeting with my BFF that is a paralegal this weekend hopefully. She already printed out all of the different forms, etc. that have to be sent to Paypal's agent for server of process.

Fu$& THEM! This whole situation is just so unbelievable. Paypal is just a scheming, crooked, fraudulent, money laundering organized crime group as far as I am concerned.

Srsly. I hadn't checked this board since I closed my Paypal acct and I was wondering just the other day if I had been too hasty in my actions.

Nope. They suck and I don't ever want to do business with them again.

I know you will win this. It's just a pain in the process.
 
Kristie - I am cheering you on!!!!!!! I had a similar situation w/ PP & unfortunately they stole my (luckily *only* $600) & still have it & there's nothing I can do.

If they call you, send a Cease & Desist letter via registered mail.

So sorry for your loss. I think I have a dispute with PP based on an unauthorized shipping transaction for $145.50 but the amount is minimal compared to your situation. I sympathize with you. Whoever hacked my account took all but $10, thankfully I transferred a larger amount out of the account on Friday and the hacked transaction happened this morning. Whew....there are wicked and evil people in this world. When I get my issue resolved I'm closing my evilb and PP accounts and will never use them again! I've had it! All the best to you!
 
I can kind of see where they are coming from when you offered everything you had to
prove the bag was authentic. At that point they had already told the buyer to destroy
the bag...they know they made a HUGE mistake by not even taking a look at your paperwork. I think they know they're on the line for the cost of the bag at the very least and their best bet right now is to stonewall you. Good luck with this. I'll never own a Birkin but will always want one and it is enraging to think someone probably with similar(lack of) funding decided to just go ahead and rip you off so they could relish in their desire to own a Birkin. She probably figured(in her warped sense of fairness) you owned a Birkin so this would be no big loss to you and that you probably own many more. I hope you get the results you deserve. I can't believe with all the documentation you can provide that PP is not allowing you at least a chance to vindicate yourself and prove what you are saying is the truth...the bag is authentic but like I said with their signed affidavit from such a trust worthy and well established (insert sarcasm) the bag is already destroyed which I think we all believe isn't the case. The buyer has to stick to that story now because she signed the paperwork stating she destroyed. She can't pull a "look what I found at the back of my closet" now. Again good luck to you. I can't imagine the aggravation, heartbreak and anger you must be going through right now.

I honestly believe it hasn't been destroyed. The scammer has it and is using it. That's all her motive involved....."How do I get a Birkin for free??" She was taking a huge chance on PP playing/being dumb but from what I read so far that seems to be a requirement to work at PP. They can have the scammer sign all the papers they want her to...truth is unless they witnessed her destroying the bag it stands to reason that the bag is not destroyed, the scammer lied by signing her name to a paper stating she did so and she ripped someone off. I love karma just as much as the next guy(girl) but in this case I would love a whole lot of legal retribution along side of the karma.

PP's whole defense rides on the fact that they instructed her to destroy the bag...she said she did and signed a document stating the same thing...there is nothing tangible left to fight over because the bag supposedly no longer exists. OP cant prove it's real and the scammer can't prove it's fake b/c it's been "destroyed."
 
^ it's interesting that you are sensing the same scenario that I am... I personally

think the scammer has the bag.. she DEFINITELY knew how pp worked.. she knew

that they would only require an affadavit saying the bag was destroyed...and she

provided "no proof" meaning a pic that the bag was destroyed... this bag wasn't

a fake.. the buyer had all the necesaaary documentation for the authenticity of

the bag.. PP never asked for any of that info... PP made a big mistake...
 
PP doesn't care who's right. All they care about is that they are out $ & will go after whoever is easiest to go after. I'm willing to bet the scammer is also being persued. I wouldn't put it past PP to double dip - as much a scammer the woman was - PP is a bigge scammer with more "Power".

I'd be too afraid of getting caught but to them it's just another day in the life of their scheming ways I guess. A few years ago we were shopping at Walmart and we had these little notebook pads in our cart..they were about 2 dollars. I found them under my purse after we got to the car. I freaked and ran back inside with them to pay. I definitely don't have what it takes to be a thief/scammer.

yes, they are certainly brazen... they start off scamming little

things and then they go for the bigger picture... personally, think

she has done this before and would wonder if she has any kind of

history of doing these things ??? but, she will get caught sooner

Exactly! She probably started with smaller items and graduated into designer goods (Coach, LV, Prada etc) and then worked her way up to Hermes. She had way too much knowledge of how paypal works for this to be her first time. She probably uses many different addresses, names, ebay id's etc.

I guess the only consolation is that sooner or later this will catch up with her. She may get away with this for a while, but eventually she will slip up. (or she will scam the wrong person who wont give up and will not stop until they get their money/item back)

who do these things will get caught... unfortunately in this situation, the buyer

lives out of the country so not so easy for someone to go after them.... that is

why we all have to be so careful of the transactions that we do....
 
Paypal is on the buyer's side. Always. I had a person buy a Chanel suit and then filed a claim against me. Before I even had a chance to respond. She returned the suit, but I swear she wore it or exchanged it for one she had. The suit was returned really beat up. And I don't sell things like that. Her money was refunded. I am still living with her negative feedback. I also had proof from other Ebay sellers about this person scaming people. All I can say is take lots of photos.
 
Wow, I am not trying to be funny here, but after reading your case, 'HEY! it is so easy to scam sellers then maybe I could also try to pull a fast one' appeared in my mind AND on the other hand, it is so vulnerable to sellers and I really sad to hear this.
