It's possible they only made your account negative because they intend to contest the Chase chargeback within the 45/day time period. Not that I don't think you shouldn't go ahead and pursue the lawsuit, but I just thought maybe this might explain the events of the day.

You know, I wonder this too? Have Chase said they have heard from Paypal? Do Chase already have all your information/evidence, in regards to your side of the chargeback? I know they know what happened, or they wouldn't have done the chargeback in the first place, but now there will be an investigation, I wonder if it would be worth phoning Chase to see exactly what happens now?

^ I agree with Silk and Kathleen. I think it is just a formality to make the account negative while they " investigate". But they will not win this one. I would still meet with your friend just so you know all of the angles.

Chase no longer has anything to do with this. The supervisor there said the money was now permanently mine and they did their part by making sure it was back in my account. They said whatever happens at this point has nothing to do with them.

I called Paypal today and was told the negative balance is there permanently and has nothing to do with any pending investigation as everything is closed. They stated it will be sent to collections if it is not paid.

I don't care. I am not paying it. They can call me all they want. I am not giving them money that belongs to me considering they allowed someone to score a FREE Birkin at MY cost.

stick to your guns..you are prepared to go after them.. just

do what you can.. you have a friend that will help you with the

paperwork and if you get any phone calls you are prepared to take

that on as well.. again, wishing you the best with this most

Send a certified letter to paypal and their legal department with the following. (You can tweak it as necessary or as desired):

Dear Paypal,

Now that my Paypal account has an $11K negative balance, I am writing this letter to inform you that I plan to take whatever action is necessary to protect my credit.

When a dispute was recently filed against me, you/Paypal blindly accepted the buyer's statements and "letter of unauthenticity" without giving me the opportunity to present my own documentation proving authenticity of my Hermes bag. Nor did you allow me to know who "authenticated" that bag. The buyer now has the $11K she paid for the bag as well as the bag and I refused to sit idly and accept this.

Thus I contacted my bank, who agreed that Paypal had no right to debit my account without returning my item to me and they issued a chargeback against paypal.

I value my credit rating and will hold Paypal responsible for any dings to my credit score resulting from paypal's negligence. I plan to contact all 3 credit reporting agencies with documentation that disputes the ding.

Why would I have thought that PP would possibly have been playing by the banking chargeback rules, when they haven't played by any other rules in your case? Oh, that's right, I still believe in truth, justice and the American way. Silly me. They are just digging themselves a bigger hole and exposing themselves as the behemoth thugs we all know they are. Perhaps this is a lucky thing and will add fuel to your legal case. Sue away, kristie! Time to take the giant down, and you are just the one to do it. Best of luck, and please do let us know the outcome. For what it's worth, you have a lot of tPF prayers and good wishes surrounding you, so keep the faith that right will prevail. Oh, and please send a letter to the CA attorney general. I'm sure your BFF will be able to help you draft an effective letter.

My goodness kristie....I just saw this thread and don't know what to say...It's unbelievable what PP did and that the buyer gets away with this so easy...what a mess...
I'm so so sorry that you have to go through all of this, must be a very stressful time for you right now.
