OMG OP! I feared this but I was almost sure Paypal would come back and try to nail you for the 11k once again. What a buncha idiots!

The collections calls are not going to be fun at all! Do you have your home phone number on your paypal account? I have my cell phone as my primary and I have an app that blocks 1800 numbers from ringing my phone or any number I wish to block. Maybe you can use this if you have your cell phone attached to your Paypal account...?

It truly works wonders. I love it!
 
THIS is what will get the collection removed from your credit reports through the credit bureaus. Once it hits, contact each bureau and forward this documentation, and they will remove the collection item.

I hate to say it, but that probably won't work to get it removed. You may get a few CAs to back off, but the $11K is going to be very enticing (they pay pennies on the dollar for the debt, so if they get you to pay they stand to make a lot). When disputing with CRAs (credit reporting agencies) the supporting documents really don't do much. The only time they are helpful is in cases of fraud. Other than that usually any additional documentation is just shredded by the CRAs and ignored.

Just to give a quick example, I had CAs come after me over medical bills from when I was a student athlete that the Univ didn't pay (they eventually paid once they found out, but the CA's stayed on my report). I had TONS of documentation from the univ, athletic director...even the Univ provost but the CRAs didn't care---if it's in your name that's all that matters. It took a BBB and FTC complaint to get them to remove. (and it came from the CA, not the CRAs)

I'm not saying OP *won't* have luck, I'm just saying these documents wont help her with the CRAs. They will only help her with CAs...but once CAs have documents from paypal that you owe (even if you believe you don't) it's going to get messy...OP may want to consider suing...especially because if this affects her credit she can get additional damages!!

The docs will show it is not a legitmate debt since the merchandise was not returned. The CRAs will take the documentation into consideration more than the CAs will. At least, that's been my experience.

I think you will eventually get it removed but I think it will be a pretty tough battle. If it gets tough, hire a lawyer, and watch how quickly things will get better because they don't want the legal hassle.

I would send the CA's your documentation proving fraud, and ask them not to contact you again. If they continue to do so, send them a notarized cease and desist letter. If THAT doesn't work, get the lawyer involved.

As for the CRAs, send your evidence of fraud, and make sure to highlight the information that Chase gave you, as Chase is pretty reputable and they are likely to believe a financial institution over Paypal. If they don't listen, get the lawyer involved again. It will likely only take 1 letter from the lawyer to straighten that out.
 
I cannot believe this. I am probably never going to use PayPal EVER again. This is beyond ridiculous. How can we track the buyer down and pressure his/her sorry ^%$ to give up this whole act?!

OP, I am afraid that you might want to seek legal counsel. This is completely unacceptable from PP.

A lot of this is getting ahead of ourselves as nothing is on OPs credit yet. As long as she DVs any collection that contacts her she *should* be able to stop anything from ever reporting. Either way, I would imagine she will need to get a lawyer involved because a CA is going to want to settle eventually (you can only hold them off for so long, especially when a collection is within SOL). Sending the CRAs those documents will do nothing...legally this debt is OPs...paypal ruled that she owes and is trying to collect. Her only way to stop this is by fighting paypal---the CRAs will not care.


The one advantage she may have by dealing with the CAs, though, is that if she keeps ignoring them one may choose to sue her (since she will be within SOL for a few years). If that happens she will have a chance to present her case and might win based on all the issues at hand. Another potential advantage---CAs constantly violate the FCRA...as long as she reads up on it and keeps strong records she may be able to catch some in serious violations and sue them along the way. Regardless, this is going to turn into a huge hassle and I'm afraid the scammer may seem like the least of the problems.

I was pretty sure that Paypal wouldn't just give up on this. In their minds, you owe them 11k and they tried to get it but it didn't work out so, again only in their warped minds, they think that you still owe them and have adjusted your account accordingly. Its pretty ridiculous if you ask me but they aren't in business to lose money so they are going to fight. If I were you I would just tell the debt collectors that <your name here> doesn't live here anymore. You bought the house from her and have no idea where she moved to so please stop calling. We did this (although it was true) when collectors kept calling for the previous residents and, after calling daily for months, they never called again. I also sounded pretty annoyed/pissed off about the interruptions. =) Good luck OP. I hope you some how come out on top of this mess.
 
OP, you are very lucky to have gotten the money back from your bank! Don't worry about Paypal...yes, they will be a major thorn in your side for some time, but I went through a similar case, and recovered just fine. I no longer have the ding on my credit, and I do not get calls any more.
They will call you from many different numbers at all hours, and it WAS extremely annoying...but I found a way to have those automated calls to stop. Maybe it's not for everyone, but I eventually put this message on my phone:

Someone said that those 3 tones at the beginning of the message will immediately take you off an automated calling list. It seems to have worked...but I had some explaining to do to friends...lol. Don't let them beat you down, you already have won by getting your money back, now play with them. Really, life could be worse :flowers:
 
I think if you flat out tell them you're not going to give them the money and use the calls as an opportunity to yell at them, they stop calling. They call a lot if you don't pick up the calls.

Also, you can report them for harassment.

I know this isn't a great time for humor, but what if you pick up their calls and use it as an opportunity to vent out your anger? Scream at them so much that THEY hang up on YOU :p

They do just hang up when you go off on them. I would however, advise against it and have her save her energy towards a resolution.

Or she can start preaching the Bible to them. That's what I do to all telemarketers and door to door salespeople. I'm super friendly and warm to them. Works like a charm :laugh:
