OP, this is so sickening! I am just sitting here, shaking my head at such complete lack of morals. I do hope our tpf detectives can help you out. And please don't make yourself sick. Good luck!
 
I'm so sorry! This is awful. You should speak to an attorney about going after Pay Pal - because you had documentation it was authentic, they should have AT THE LEAST demanded the return of the item. Since they are the ones that decided you weren't going to get it returned, they need to pay for it.

I would contact Pay Pal on Monday one last time and ask for an ambassador. It's a new program that they have started since the sellers are being ripped off and scammed so much - they now have ambassadors that have the authority to make immediate decisions on appeals or handle special problems that sellers are having.

Does this buyer have an eBay ID? I know we'd all appreciate having it so we can block this scammer.

Also if you can provide information about the buyer and where they are located you might be amazed at what the tpf detectives can turn up with. Want to bet this purse winds up being sold by the scammer?

Also you can also try to file with Canadian law enforcement - this is theft of over $10,000. At a minimum they may be able to contact the buyer to find out where the purse is now.


Exactly what I was thinking, Apricot. And also, when she sells it, I bet the fake one that she had "authenticated" will be the one that goes out to whoever she sold it to. I realize this was an off ebay transaction, but I feel like her ebay ID would be useful so we can watch what she is doing, checking into what she has bid on, etc. The TPF detectives will be on her right away! And I most definitely want to block this horrible buyer. I just feel so bad for the OP. What is going on here just isnt right. I hope that the media really does pick this up and shows all of America what a horrible company PP is. They just cannot keep doing this to sellers. Its just disgusting how little they care. Keep fighting OP!

As I say, they might still have found in the buyer's favour, as it might have just been assumed that the item was a bait and switch, on the seller's behalf; but if you had appealed it, then I'm pretty sure they would have looked into it in greater detail?

Might still not have done any good, I know, but at least I think you would have stood more of a chance of a fairer hearing?

Have you tried to contact the buyer via telephone? I would be on a plane so fast to Canada paying her a visit with a Canadian Attorney- her head would spin....:bagslap:

It would be nice to know the ebay id to block her from doing this to anyone else.
 
is it a silly question to ask whether you can sue paypal or not?

i understand its the buyer that said its SNAD, and that it is 'fake' but it is paypal that told her to destroy your property and took the 11k from you.

I know this may be last on your priority list, but I really think it's something you should do (it won't get your money back however). You need to file a complaint with the State Attorney General's office in California. You need to give them a complete factual run down of what happened - you had original receipt, authenticity document, etc. and that Pay Pal completely ignored all the relevant proof and provided no seller protection, despite stating in their advertising that they do. It's false advertising and they acted as an escrow company - and then stole your goods.

If enough people file with the state attorney generals (and also the Justice Department, which would be federal banking authorities), you can bet that Pay Pal WILL be investigated. They are HATED in the credit card industry and I know people who are in management at two large California banks that would love to see Pay Pal get regulated and held to the same banking standards.

What Pay Pal did here is just WRONG.
 
You may have some recourse against PP for instructing the scammer to destroy your bag. I don't know where they have the legal authority to destroy someone's property whether or not it is authentic. They have never seen the bag and have no way of knowing whether it is authentic. They don't know whether scammer had your bag "authenticated" or some bad fake authenticated (bait and switch). They also don't know if the "authenticator" has the first clue about how to go about authenticating H bags. What they have essentially done is order someone to destroy your property - whether it is worth $250 or $9000. I would mention this angle to the attorneys you are speaking with on Monday and see if they can make something out of that. If you go against PP, you can do so in Small Claims Court here in Calif. Attorneys are not allowed but you can have help pulling your case and your evidence together. I think it is a pretty easy process and you may get at least some satisfaction that way. I am so sorry about this mess, OP!

I cannot appeal it.......PP told me it is not an option because the bag has been "destroyed" by the buyer........right.

Yes, I am going to watch for it on Ebay and I can bet she is not going to use the same ID as she did to purchase it...she has been too slick for that kind of dumb move. Or, she will keep it OR she will consign it. I will be looking into ALL avenues.
 
If paypal told the buyer to destroy this bag without any verification or

explanation from the seller, shouldn't paypal be assuming some responsibility for

that decision??? Is there anything stated in their bylaws, that if an item

is fake that the buyer has the right to destroy?? Paypal simply can't be getting away

with this.. Besides this $11K sure there are plenty of other people that have not

pursued their money because they are hammered with dealing with paypal...
 
I could not agree more.......PP told me they have to have the buyer destroy it because they have been sued by LV, Hermes, etc. in the past so this is how they "protect" themselves.

So the billion dollar company gets "protection" while I am out $11,000.
