Now THAT is an avenue that I can look into further when I contact an attorney Monday. I am planning to contact the firm that authenticated my bag for me as they specialize in copyright/trademark lawsuits.

Thank you for this idea.......I am so frazzled I did not even think of that yet.

You're welcome! Good luck, Kristie!!

I am completely sickened by this story. I am so, so sorry.

A friend of my sister's lives here in the Bay Area and she used to be a producer at KRON (and still might be, I'm not sure), if you want to PM me I could put you in touch with her and she might be able to get you some press. Let me know and I'd be happy to help.
Awwwwww thanks sweetie. I will def keep this in mind!! Especially since PP corporate is in the Bay Area, CA.

I'll be back in a bit..........gotta go act "normal" to the hubby and step-kids.

My DH has always told me that I should stop doing the PP/Hermes hobby because of all the scammers.......I cannot bring myself to tell him......yet, anyways. I just cannot deal with anything resembling, "I told you so" right now KWIM?

I'm so sorry! This is awful. You should speak to an attorney about going after Pay Pal - because you had documentation it was authentic, they should have AT THE LEAST demanded the return of the item. Since they are the ones that decided you weren't going to get it returned, they need to pay for it.

I would contact Pay Pal on Monday one last time and ask for an ambassador. It's a new program that they have started since the sellers are being ripped off and scammed so much - they now have ambassadors that have the authority to make immediate decisions on appeals or handle special problems that sellers are having.

Does this buyer have an eBay ID? I know we'd all appreciate having it so we can block this scammer.

Also if you can provide information about the buyer and where they are located you might be amazed at what the tpf detectives can turn up with. Want to bet this purse winds up being sold by the scammer?

Also you can also try to file with Canadian law enforcement - this is theft of over $10,000. At a minimum they may be able to contact the buyer to find out where the purse is now.

No, my account WAS negative $11K when I had moved the funds to my checking account BEFORE the dispute was activated. I put it BACK so the balance was $0 instead of negative $11K so I could continue buying and selling small things.

It is at $0 right now. So, yes, PP did take the $11K. I have excellent credit and am not willing to mess that up by having collections after me for the rest of time messing up my credit score.

Oh, OK, so you are really out the $9K bag which still sucks. I was hoping you would have at least gotten the money before Paypal took it. I know for sure my credit took a hit over my Paypal situation, but it has been a while ago and I have recovered (just dispute it with the credit bureau, and they will remove it). I don't like to be bullied by 'thieves', and I'm very stubborn, so I didn't cave in to them. I really can't believe what they let people get away with. When will they be investigated???

Which province or city is the scammer in? You can file a small claims court file in ontario for anything under 25k, its $276 to file the case and all of the paperwork is available online. Im in ontario and would be willing to assist you in any possible.

No, PP took the $11K from the start when the dispute was filed and kept it as "held pending investigation." I am out $11K PLUS my bag that was $9K.

very good suggestion... catch your breath we all know that you are
beside yourself... make the phone call and just keep moving in a
positive direction... we are all hoping that you will get some justice
here... paypal just can't keep making these very poor judgement
decisions....

Thank you for that new info Apricot! Of course the claims supervisor mentioned nothing of the sort.

PP truly has the attitude that someone should be totally fine with a $20K loss. The supervisor could have cared LESS! I asked her how she would feel if she lost $20 thousand dollars! Her response?? "I am not in that situation so how would I know?" She was SO rude!

But didn't the $11K come from the buyer? I am confused. When Paypal sided with my buyer, I had already taken the money out that my scammer paid me with and Paypal just made my account negative. Did you not get paid from your 'buyer'?

I had a security tag on it and PP did NOT CARE.

Did you mention and/or picture the security tag, in your listing?

Also, how quickly after the auction ended did the buyer escalate to a claim?

In other words, did they leave it sufficiently long that the listing was no longer viewable, do you think?

So sorry this is happening to you, BTW. Hopefully, something can still be done.

If it makes you feel any better, at all(?), you haven't really lost $20,000.

Depending on how you look at it, you've either lost a bag worth $9,000 + your time + expenses, or $11,000; not both.

Basically, the buyer stole the bag + your time taken to list it + any non-refundable fees. They didn't, also, steal the money; it's just as though they never paid you it.

After all, you would never have been in a position where you had the bag and the money, would you? So, in terms of loss, it's also either one or the other.

Still a hell of a lot to lose, though, I know.

no, i think really you're out $9k for the bag. she paid you $11k, and they took that 11k away so you're back at square one for that one. you lost 9k because you're out the bag that purchased.

not that 9k is pennies, but look at it that way. you would've been 2k ahead had the sale worked, so maybe you can say you're out 11k, but not 20k.

The buyer paid me $11K to my pp account.
I transferred the $11K from PP account to my bank account.
Buyer did full dispute making my account negative $11K since I had transferred the money to my bank account.
I transferred BACK the $11k to make my pp balance $0 so I could continue selling.
So now that the dispute is over pp gave back the $11k that was being held by pp to the buyer.

I original paid $9K for the bag that is now gone.

So yes, it is $20K total loss.
