So it's not "unfair" for someone to lie and tell you that what you are buying is pearls w/ white gold and a diamond when really its just overpriced junk that he could have bought at Claire's? If that's not unfair I don't know what is.
As a lawyer, or at least a former law student, should KNOW that is fraudulent behaviour not to mention illegal. If they did actually do this then you AND your boyfriend need to take it back and speak to the manager. Tell them that the sales associate -and have that person's name ready - mislead you and you demand a refund. Why? Because, if that actually is the case, you were defrauded. But you had better have proof that the sales associate actually claimed the piece was real. And your boyfriend's brother's word isn't going to cut it.
As for their return policy, I don't see why that store would tell you that it was 'exchange only' yet the website has a completely different policy. These are things YOU need to point out to the manager of the store the purchase came from. I don't know if they have the return policy listed in the store, or on the receipt, because you've yet to answer that question
Also, I've stated NUMEROUS times that he asked questions about the necklace and was told it was (freshwater) pearls, white gold (14K) and a real (although very small) diamond. And he's not the only one who heard this line of lies- his brother was there and heard it all too.
Prior to the current post I'm quoting, you 'stated' this information ONCE. Reply #23, page 2, and that was only in rebuttal to my questioning, to another poster, about the basis of the credit card claim. This little tidbit of
important information was never given in the first post, as it should have been, and none thereafter. Again, if this fraudulent behaviour did happen then you should be pushing for a full refund and a heartfelt apology.
I'm starting to think that you just like stirring the pot. This situation isn't a guy going into a jewelry store and paying $29 and crossing his fingers that the necklace was real. This is a smart, educated man looking for a nice gift for his GF's big day and being taken by someone who is an outright liar. There's a big difference.
Too funny! If 'stirring the pot' was my intention I would have more posts, especially in this thread. I'm a lawyer and it's my job to see different sides of stories and debate things especially when they don't add up. If you want me to be brutally honest with you, I find your story implausible. There's just too many things that don't make sense. I can't believe that a 'smart, educated man' didn't realize that he was buying a fake, especially since there were no markings of it being real gold. I don't know what the piece looks like, since you've yet to post a picture and you claim this piece isn't on their website, so I can't tell you if it appears real or like a piece of costume jewellry therefore worth the $900 he paid for it. Landau Jewelry is forthcoming that the pieces are costume yet the sales associate, in this store, blatantly told your boyfriend that the pieces were real? Seems rather odd to me. Not only did they put their job on the line but the company's reputation as well. I also find it hard to believe that this is the ONLY store that doesn't have signs indicating the authenticity of their pieces or their refund policy in full view. Sorry but it just seems 'fishy' to me. If I'm wrong then you have my apologies.
