Just Bought a fake Alexander Wang on ebay (and didn't receive it yet)

I in no way support a buyer keeping a bag, counterfeit or not, and being reimbursed. That is too open for fraud. AFAIK she will have to return the bag for a refund. Yes, the seller should be responsible for return shipping, but they are not required to. Personally, I would pay the postage just to get my refund and be done with it. Appropriate feedback can be left at that time to warn other buyers.

It is ok for a regular transaction but it is an international transaction 18 pounds to ship first and then pay again to send back a fake??
Not in my book. And I won't even go into the legality of it all.
The least the seller can do is take care of the postage.

Yes, I just want the money that I payed back. I don't care too much about the shipping, but the seller don't answer in no way.

Original shipping should be reimbursed when the OP wins her case.
I am curious as to the legalities mentioned. Aside from sending the bag through Customs what are they?

Sorry, Poopsie, I'm not sure I understood. You said that I have to send back the bag BEFORE I receive may refund, isn't? And the seller is supposed to refund me AFTER he received the bag? I have no problem to send the bag, but I want a guarantee that the seller actually refund me...
 
OP.. you have opened a case against the seller is that correct??

When you ship back the bag do it with online tracking & you should
be able to forward that info to paypal/ebay for them to see that the bag has been
returned if you have a problem getting your refund from the seller

The shipping should be refunded... and do agree that since the bag is a fake
why should the buyer have to pay postage both ways..

There have been instances where Paypal has let the buyer keep the bag (with the intent that they agree to destroy it) and receive a refund. A few TPFers have been scammed out of authentic bags in this way.

What happens in a 'normal' dispute is that the buyer opens the dispute by filing a claim. They state their case and the seller has a chance to respond as well. Should the case be decided in the buyers favor they are usually required to return the bag (with insurance and the appropriate tracking depending on the total amount of the sale) and the seller refunds upon receipt.
Unauthorized returns by a buyer are against Ebay policy (from what I have read-----I have no idea which if any of their policies they actually enforce any more) and can void the Buyer Protection so it is best to get the OK from Ebay before returning the item.

ok, thanks! I didn't' know that there exist this hoaxes from the buyers. I'm new in the ebay bag's world...! I don't have any desire to keep this bag...I'll open a claim and I'll follow what Ebay will say...

Open the case first. Do not ship the bag back until ebay instructs you to do so. You may be required to give proof of inauthenticity. So while you are waiting for ebay's response, you may want to look into how to get it professionally inauthenticated.

You should win this case. You will probably be instructed to return the bag and will be refunded the original purchase price and the original shipping. Use signature confirmation and insurance. Once the bag tracks back to the seller, you will get your refund.

ETA: Here is the link to information about having bags inauthenticated. I would not pay for an inauthentication unless you are instructed to do so by ebay but it would be helpful to get your ducks lined up in case.

thanks! I just opened a case on ebay, but ebay forwarded may claim on Paypal directly, I had to fill the case form on Paypal. Now I have to wait until the seller's answer. Pay pal said that if the seller doesn't answer until the 17th december, I have to do a "reclamation"...(I don't know how to explain in english)...
 
but if the listing states that the seller takes returns doesn't that mean that they take them for any reason including buyers remorse and 'just because'? I didn't think that sellers could cherry pick reasons.
The listing says Returns Accepted and the buyer wants to return but the seller is not cooperating. It should be an open and shut case shouldn't it? :rtr: I guess you never know with Ebay. :nogood:

ehm...yes, you're right...I don't know much about ebay. I did what you suggested because the seller doesn't answer...I'm trying to do all my best and all in the legality, because I think the seller did a fraud against me.
