Scarves Hermès Spring/Summer '19 Scarves

The request was rather vague, but pointed out @yodaling1 's postings from early December. I deleted those and subsequent posts from this month in this thread.

Fact is that the images posted are indeed copyrighted by Hermes and (perhaps at the time of H noticing) partially unreleased to the public (?). H holds copyright to all those images either way, I am not sure in how far fair use is applied to the images.

There are other posters in this thread who shared collection photos, but they were not explicitly called out in the takedown request, so I did not remove them, nor any other user posted images.

This is terribly disappointing I am sure, but seeing as it was an official DMCA request on behalf of H corporate and we run the danger of our host shutting down our entire website due to non-compliance, I had to take action.

So to be clear, they were upset at the timing of the scarves being posted? Once they released ss2019, we’re allowed to share official photos? I don’t want to off-put yodaling and wen who have been so helpful. If they can post after a certain date or the first scarves being released on a website, I would be less upset with h.

@Vlad It is completely understandable that you had to take the action that you did. None of our grouches are aimed at you....just at the faceless behemoth that seems to constitute H these days.

Perhaps it is their obsession with fakes that drove this. Perhaps not. How would we ever know when no explanation was offered? Anyway, I bought myself a nice Mulberry bag today and popped into LV next door. They seem to have rather lovely scarves too.

In future maybe @yodaling should just post the links directly to their site rather than post the images. Would they prefer that, I wonder?

They say they do not just sell pretty things but endorse a life style. That dream just turned sour.
Great minds think alike! I just wondered the same re links. That doesn't breach copyright as far as I know because you are directing traffic to their image on their site.

The overview provided by yodaling and her predecessors over the years have given me some of my happiest moments on this site. I will truly truly miss her overview.
Nevertheless, from a practical standpoint, seeing members model the new releases provides a clearer sense of the collection to me. The colors, the way the designs drape IRL, the way a design is highlighted by outfits and jewelry (big wave to living.la.vida.fifi) is a stronger incentive to go out and acquire similar H items. Members' mod shots make the scarf designs and colors come alive in a way the H site pictures do not. This is something H cannot take from us.

I would like H to quit showing scarves tied in the hair. It's boring (IMO) and nobody wears their scarves that way (IMO).
 
The photos might not have been properly credited to Hermès. They own the copyright.

That’s why I watermark my photos. Someone took one that wasn’t watermarked and used it to sell a item that wasn’t mine. It was annoying, to say the least.

While this is all very disappointing, I do understand H’s request to not share THEIR pics of scarves that aren’t available yet online (early December?). You mentioned unreleased, fair enough.
What I know for sure they have not requested (because they simply can’t) is to delete pics that are taken by tPFers themselves of scarves they’ve seen or bought. Or screenshots of H.com. Nor pics that were shared here that were found on IG, taken at H press days or events. So I don’t get why some of these were actually deleted?

It can’t expand to pics that are for all to see on H.com, as they put them out in the public domain. (Or it would expand to for instance the Web Finds thread too. Let’s not even talk about Google Images.) Their issue isn’t with pics of scarves that are readily available online, so let’s not try to find a solution for a non-existing problem there.
 
I am super bummed by this like everyone else is but it is what it is.

My one biggest concern now is we will not have any pictures for future reference if we are not allowed to post these photos ever and as we know, Hermes does not store these photos indefinitely.

Can we still post photos after the collection is released? I would like to get a guideline as to if and when photos can be posted/reuploaded if that is even a possibility.

Using copyrighted material for profit without permission IS against the law. Using images posted by a company on their public sites for education purposes (a forum dedicated to the education of H’s S/S 19 scarves) shouldn’t be illegal.
And, I don’t know how much more we could be crediting H than them being used in a thread on a blog titled Hermès S/S 19 scarves.
This thread focuses on all of us discussing H products. No one is using them for gain, except to gain knowledge, which would fall under the Fair Use laws, IMO.

Vlad himself mentioned “unreleased” as not permitted by H. If they meant ALL scarves pics, they would have said so, corporations will not leave anything to the imagination with these kinds of commands.
They can’t really stop us from posting pics that are out there and available on their own website. It’s not like we are misusing the images. If anything it’s a huge marketing tool for them, free of charge. And everyone here knows how much more scarves are sold because of it.

Well... I'm pretty sure H could make a claim that their copyrighted material is being used for profit. WE use them for educating ourselves, but these pages have ads on them, and page hits generated by people clicking to see the scarf photos = revenue for the owners of this site. That sounds like profit to me.

That being said, H is also clearly profiting by our being able to see these scarf photos, get excited about them, and hunt down the silks. So their getting wrought up over anyone else incidentally getting money from these pictures being posted here seems like cutting off their nose to spite their face.
