Yes, I think so. I believe a seller is suppsed to KNOW it's authentic before listing. They can't say they 'think' it is, or even it is a fake. I wonder if anyone here got a look at it before it was removed?

Counterfeits of any items bearing a valid registered trademark aren't allowed to be sold anywhere in the US under ANY circumstances - not on Ebay or at Goodwill stores or at a garage sale or anyplace else. US law absolutely forbids selling counterfeit merchandise, period. Even if someone says up front that it's a fake doesn't change a thing.

This is the US statute, most states have similar laws on the books:

Here's Ebay's official policy:

"Sellers should make sure that their items are authentic before listing them on eBay. Sellers may not disclaim knowledge of, or responsibility for, the authenticity or legality of the items they offer in their listings. If a seller cannot verify the authenticity of an item, it can‘t be listed on eBay."

So I'm asuming that's why the bag in question was removed. The seller stated it was a 'knockoff', but Jen was questioning that it even was a knockoff. I didn't get a chance to look at it before it was removed. I was curious if I could tell by looking at it!

Both are probably okay but #1 should have at least a photo of the inside.

I saw that listing for a Sabrina bag. I don't know whether it was authentic or not but the seller described it as a "very good knockoff." I'm sure that's probably why it was reported and removed.

Thank you very much, I will put up a picture of the creed when I get the bag. The seller said it was from her personal collection and she has only sold one other bag out of the 1700 feedback she had, she also told me what store she purchased it at...however she had misplaced the dustcover. She sounded believable but I want to make sure, and I was not sure if the CC pattern needed to be centered on those squares of this bag.

From a legal point of view it all depends on whether or not a trademark is being violated. Coach's Signature Cs on a bag not made by Coach means counterfeit, but a pattern using Gs or Os is just "designer-inspired" and legal to sell as long as it's not violating someone else's registered trademark.

"Knockoff" means illegal counterfeit but some fakes sellers seem to think that using the word implies that it's legal to sell as long as they're not claiming it's real, and that just isn't the case. It doesn't matter WHAT the seller says or claims, all that matters is what marks, graphics, logos, etc are on the item itself.
 
I think you got a REALLY nice bag! There are probably at least a dozen people reading this, myself included, who are kicking themselves for not bidding or wondering how they happened to miss that auction. ;)

No, the Cs are never deliberately centered on the patches, and the patches can be different on every bag. Only the placement of each patch has to be the same across the line. And the back should either match or be a mirror image of the front. Unless there's a pocket involved. :graucho:

Speaking of that famous and usually valid (well, about 90 percent of the time anyway) "rule" about the Cs always being centered, some of the new Tartan Signature bags and accessories made for the outlets DON'T have their C patterns centered, so along with Scarf patterns, Sig Optics, some Scribbles and a few other styles, don't always depend on that "Cs must be centered" rule either. That usually only holds for standard Signature C and most of the Op Art C patterns. Always be careful with anything that's supposedly a Rule. Coach's motto seems to be that Rules are Made to be Broken. The one consistent thing about Coach is its inconsistency.

Oh, and you said "I forgot to mention this is a Coach Holiday Patchwork Tote and I have been unable to find any other posts reagarding this type of bag." That's because the style is from 2006 or '07 and there isn't much to find here about the older styles. The older posts also get archived after a while when threads get too big.

I emailed her earlier for better pics of the patch the inside and any detailed spots like the zipper and stitching etc. well I got word from the seller. she said ebay closed it and she didnt fully understand why and I explained it to her. she said this "I bought the bag on Ebay for over $200 a few months back. I thought it was a fake because I bought it for less than half of the retail price of $498. The bag is in good used condition, and exactly as described. I am not a collector so don't know much about bags. What is your email address I will take pics for you. anything else that would help authenticate it? "

It is getting harder and harder to spot the fakes, but I snagged that bag on a BIN for $55 plus $12 for shipping, it has a little wear on the suede patches, but still looks to be in pretty good shape for its age, so I am thinking I got a pretty sweet deal...I did tell her I was NOT interested in purchasing it if it was not authentic...so I will keep my fingers crossed that this is the real thing.
