WARNING, Paypal just made me lose $20 THOUSAND dollars from a scamming buyer

My first step will be getting a court order for paypal to release all documentation and the BS "proof" the buyer had stating the bag was not authentic...... Just so I know what I am dealing with.

As far as suing PP goes, I know they have wayyyyyyy deeper pockets than I do and will probably fight tooth and nail to keep their $11K while I waste a ton MORE money in atty fees.

I still am planning on contacting an Intellectual Property attorney on Monday.
 
Yes!!! I totally get it!!! Does UPS actually do that? Do they package the item themselves? And if they do, can you ask them to make note of certain things like a security tag? Would they just retain it to memory (and hope you don't have to summon the poor chap for a court case down the road) or could this be documented somehow at the time of?

I am fairly certain that they do but it is for a fee and I know that mom & pop shipping stores definitely do and may have more time to spend with the individual.

In terms of documentation, photographic or video evidence is better than human memory -- in other words, if I was the seller in this case I'd not only have evidence that my bag was authentic (authentication papers), I'd also have photographic or video evidence of the unique characteristics of that bag (the stamp) along with whatever security tag I was using at the time it was authenticated and at the time it was being packed up to ship out. I'd also document the person's name who was doing the packaging and even draw his/her attention to the unique characteristics of the bag that was being shipped out to create a more or less verifiable chain of custody, for lack of a better term. Now, I don't think I'd do this for every sale but if I had a $9k bag, I'd take the time.

Also, and this has never been answered by anyone at Paypal as it's "case by case" basis, but I believe that an unrelated third party vouching for what was sent along with photos of the same MAY be evidence they'd actually consider.

EDIT: let me rephrase -- by "vouching" I meant a notarized affidavit.

Good luck to you, OP. However, do you mind me asking why you need an IP attorney? I mean, it's up to you but unless I'm missing something, you're dealing with a civil matter (from your side - although it's still a criminal matter for the scammer in this case) and you'd want an experienced trial attorney rather than someone who deals with IP...
 
I'm sorry you got scammed OP and I hope you're able to get some justice, but if you intend to keep selling on Ebay, you can not refuse to accept Paypal unless you have your own merchant account. Otherwise you will be suspended if a buyer reports you for refusing to accept Paypal. Sorry.

I wonder if this could be an inside job....seems all too convenient. Imagine some unscrupulous person employed at Paypal, the damage they could do. I wouldn't be surprised.
 
So sorry this happened to you!! This is the worst paypal scam ever!! Sickening!!

Please, please OP, share her ebay ID so we can all block this horrible person!!
 
This is by far the worst eBay story I've ever heard, and I'm sooooo sorry for you, and hope everything will eventually work out.

I just got scammed $1800 for the Chanel shopper, and I eventually got my money back just by telling her I got the police involved, and I'm summoning her to court. She was in the u.s. Though.

My advice, besides you doing legal attorney stuff, is find out all her info, and tons of us here will help you do that, and literally destroy her until you get your money back. What I mean by destroy her is - let everyone know what she did at her workplace, call her boss, call her family, call her church, tell everyone how she just stole $20k from you. Let her world know the scammer she is.

I'm not saying this will get your money back right away, but it's a step. This women must be stopped, and she won't get away with it.
 
You can and should file a report with the Mounties in Canada -- I don't know who told you otherwise. Also, you do not need an attorney in small claims court - you can represent yourself as it's not formal. You would need to file the paperwork and you may want to pay an attorney in the city & province where your scammer lives to file those papers for you so you don't have to fly up there twice but it won't cost you more than $300-500 for that type of work. (Although if I was in your shoes and I was dealing with a $9k loss, it would be worth it to me to have professional representation throughout the case. That said, as long as you can prove you actually sent an authentic bag -- did you photograph/record yourself sending it? Did a third party watch you do it? -- you should be able to get either the bag or what you'd paid for it given it's within the cut-off sum of the small claims court you file in.) The bag has ben destroyed... OP said that PP faxed an affadavit

to the buyer...buyer responded saying the bag has been destroyed

in spite of the OP proving that the bag was authentic with paperwork

so no bag and no money... hard to comprehend that this happened

so fast and that the OP which has positive feedback and the buyer

has none.. that they would just take the word of the buyer over the

seller knowing that they are so many scams on Hermes and other

high priced items...
 
OP, nothing to add but to express how sorry I am that you've being scam and out this much money. This is really horrible! Most of the fault is with Paypal, they sided with this scammer.
Do not give up, keep fighting!!
