When I contacted the company that authenticated the bag to start with, that was the type of attorney she suggested. She works for an intellectual property firm. It makes sense to me........It cannot hurt to call one.Good luck to you, OP. However, do you mind me asking why you need an IP attorney? I mean, it's up to you but unless I'm missing something, you're dealing with a civil matter (from your side - although it's still a criminal matter for the scammer in this case) and you'd want an experienced trial attorney rather than someone who deals with IP...
Actually, you can accept Moneybookers now as an accepted form of Payment and not Paypal.I'm sorry you got scammed OP and I hope you're able to get some justice, but if you intend to keep selling on Ebay, you can not refuse to accept Paypal unless you have your own merchant account. Otherwise you will be suspended if a buyer reports you for refusing to accept Paypal. Sorry.
Yep, here is the actual email from PP yesterday stating the bag has been destroyed.......when I CALLED them they explained that since the buyer signed an affidavit stating the bag was destroyed, then of COURSE it was......because a SCAMMER would not LIE, right????The bag has ben destroyed... OP said that PP faxed an affadavit
to the buyer...buyer responded saying the bag has been destroyed
in spite of the OP proving that the bag was authentic with paperwork
so no bag and no money... hard to comprehend that this happened
so fast and that the OP which has positive feedback and the buyer
has none.. that they would just take the word of the buyer over the
seller knowing that they are so many scams on Hermes and other
high priced items...
The idiotic "supervisor" at PP was so rude it was UNBELIEVABLE. She just kept repeating herself over and over like a broken record saying, "the bag was destroyed because the buyer signed an affidavit stating she did so." She also said, "Of course we do not demand photos of the destroyed item, the buyer signed a legal affidavit." May I add the affidavit is NOT NOTARIZED stating the destruction of the bag was actually witnessed??This story is very disturbing. Think of the crooks reading this & getting an idea they can pull this now. (No way should this thread be shut down)
I would not feel bad about asking for a wire transfer for a large purchase such as this. Till they pay for it, its your bag, your rules. If the buyer doesn't like it, they ned to just move on.

How did she CLAIM she destroyed it? (we know d@mn well she didn't) Its not going to be that easy. They need to ship back the shredded evidence to the seller if they go this way without a third party doing it.

I would start off with a suit against PP to release all the records relating to this. She filed an affidavit. Fiddle-dee-dee. You file an affidavit. Before you even file suit, file one with them. And a letter demanding release of the records, even if they are going to deny it anyway.

As Vegas Long Legs posted a third party should be responsible for doing this after checking all the pertinent markings unique to Hermes bags and comparing them to what the seller claims and what the buyer claims. Does it say in the listing agreement they can destroy it or have it destroyed by the buyer without your prior knowledge or consent? I suppose they have covered their butts in that manner. Plus if you are out 9K or $11K whichever you are probably not in small clais, but District Court. Not sure what jurisdiction you are in. Does PP have an arbitration clause in their agreement?

I also find it outrageous that PP believed a ZERO FB buyer over a seller with a proven track record...what does it take???
I am so sorry Kristie...just sick for you!!! I have a feeling your bag will appear, somewhere, one of these days. Scammers are greedy!
I even typed a 3 page letter to PP stating why I felt this woman was going to pull a bait and switch and that she would have a fake bag authenticated to try to keep my authentic one AND get her money back. I wrote the letter and basically SPELLED IT OUT verbatim her whole scam which she has now successfully completed. I wrote the letter to make it clear what this person was doing from the start. I also wrote it because I figure I am smarter than the idiots at PP and I thought I would do their work for them.The thing is no one knows what POS the buyer would have produced to Paypal or whomever. Or if she returned it, the same issue. She could have snet back a kid's backpack.
