Wire transfers are great for sellers but are NOT good from a buyer's prospective if you do not know/trust the seller.

Wire transfers are pretty much unprotected.......once the money is sent, the deal is done. Great for sellers who do not want to be scammed but opens up a door to BE scammed as a buyer.

We cannot win.

I am still just in a holding pattern with the negative PP account. They call me weekly to ask when I am going to pay it. I told them I am not...period. I told them to just send it to collections because they are not getting a dime from me. The last PP collection agent that called me was an ASS and basically screamed at me telling me it was MY responsibility and had nothing to do with PP. K.....whatever. I hung up on him.

They only respond to the noisiest freakin' squeakiest wheel on the planet. That means telephoning EVERYBODY on the list there, emailing EVERYBODY (CC'g on emails is the fastest way) everybody on the list, once a day from the CEO and President to every one of the Executive Escalations team members. Everything you need is on this website. One of the most important steps is including a list of all the organizations and people (including state senators and congressmen, etc. that you are going to enlist the help of that will scare the pants off paypal and a threat to have them audited like Enron - I think that's what did it for me!!) It is amazing, and it really does work. God bless the man who compiled all the info. Yes, people due sue paypal but you don't have to. Just follow what they tell you to do here and do it to the letter (and yes they even tell you what to write and how to write it and who to write to).

Paypal's policies are whatever they want them to be. They make them up to suit the situation and they will continue to do that until you wear them down. I had an international buyer who committed fraud who also admitted in it writing to me and I produced everything under the planet to PP and they still refunded the buyer. Eventually, after I found that website and went through every last step they recommended, PayPal backed down. You have to be thorough, but IT WORKS. Do it. Then switch to GoogleCheckout! :smile1:

I sure as hell wish I had had the energy to pursue this for my $1100 scammer. But for $11K, I probably would spend day in- day out harassing these creeps (PP) for supporting scammers if I had lost that amt.
 
You could consider the traditional route...dv letter, cease & desist along with it then wait. Ignore all calls and wait for them to sue for the money...when they sue you provide all of your evidence and (I would imagine) win. I'm sure others with more experience would chime in, but that's how I would handle it. I'd also check out credit boards...lots of experts with collections and situations like this who could advise you on how to proceed.

Do you know the statute of limitations in your state? Essentially you just have to ride the wave until then...after that they can't sue you and you're home free(it could be 3+ years, but it would be worth knowing...)
 
Hello to the OP and let me say that I offer my sincerest sympathies for this regrettable situation you've been put in by the unscrupulous buyer and by PayPal.

Although my background is in family law, civil litigation, and business and contracts law, presently I manage my own money as an investor.

tPF is a relief-valve so-to-speak for the intensity of the stock & bond markets, particularly in this volatile environment where so many counties are on the financial brink, or in the case of Greece, Ireland, Spain, & Portugal - these have already gone off the proverbial edge.

With this in mind, along with increases in national and local taxes in the EU, an increase in the VAT tax to 20 percent in the EU, and increases in council taxes in Britain, I really do not think that sellers should risk selling outside the USA at this point.

With all of the financial pressures upon citizens of the EU, there is too much risk for fraud such as what was done to you.

Most of the sellers I buy from have put notations in their listings that they will not sell outside of the USA. Sometimes specific nations are mentioned such as Italy (frequent), Belgium (not sure why, maybe customs?), Spain and Canada.

Should you decide in the future to sell on eBay, may want to consider language in your listing restricting sales to the USA only and along with that, all bidders must have ten (10) or more postive feedbacks with no negative or neutral feedback.

May want additional requirements for Hermes bags or other costly bags such as Lanvin and that is buyers must have successfully purchased at least two (2) handbags on eBay prior to this auction. Their successful bid on these bags should be at least $995+. You should state in the listing that the winning bidder who fails to possess all of these particulars will have their winning bid rescinded.

Doing this should weed out the skips and cons.

I mean, really ramp it up and get exclusionary.

$20k is not a small sum to lose in this present financial environment and you have to protect yourself not only from potential liability but also from false accusations.

That is why it is not credible to ask for that form of payment from a buyer cause of the trust factor even though we are recommending it here. On the other hand, from the seller stand point, he/she is completely at the mercy of buyer and paypal, shipping out an item that cost her/him, a few thousand dollars. It is a dilemma...

Agree; it all comes down to how much money you can afford to lose.

Part of the process of getting them to leave you alone is instructing them to not contact you by any means except in writing, by a physical letter (NOT email). Every time they do it, you document it and it helps build an additional case of harrassment against them. It's a lengthy and frustrating process, but worth $1 to $20k in my view...that website is worth a look. Once I followed the advice, it wrapped up my dispute in a much more organized fashion. I just had to keep following all the steps.

PP still calls me one to two times a day but they have not yet sent it to collections.

EVERY time they call, I tell them to STOP calling me and to send it to collections because I am NOT PAYING them.

They still call.

I just received a letter from my bank stating the transaction/case is CLOSED and Chase decided the transaction was UNAUTHORIZED from my account.

Per Paypal's OWN User Agreement, they will NOT hold the account holder responsible for transactions found to be unauthorized.

PP did not CARE that I had this letter and still insist I owe them the money.

At this point, the idiots cannot follow their OWN user agreement yet they harp on everyone to follow it.

Paypal is such a corrupt horrid organization it is downright unreal.

Send a copy of that letter from Chase to the three credit reporting agencies. They have to put it in your file and if the paypal charge shows up as being in default, you'll have the letter on record disputing it.

according to their "own terms agreement", I do not think Paypal would turn this to collection agency.

they are just trying to harass until you can't put up and pay. What an idiot paypal is!

It states online that the item MUST already be on your credit report to dispute it though..........meaning if I send them a letter now, they will not acknowledge it I believe.
