Yes, but this is what I'm saying.

In the past, the seller, in a situation like this one, would have been given the benefit of the doubt; rather than the buyer.

However, dishonest sellers were abusing that situation.

This is why eBay/PayPal changed their rules to favour the buyer.

Of course, now, scammers have realised that that is the case and are, no doubt, exploiting the system as buyers.

They should just do it in cycles. Do a few years when they favor the buyer, then take a few years to favor the sellers, maybe throw in a month or two here and there where they switch it up a bit. Have everyone guessing so much that they would have to all behave!!
 
I really think the avenue that an attorney will want to pursue is paypal.

This would be ideal because:
1. These bastards deserve everything that comes to them
2. They are local for me..... I mean literally.... Paypal corporate HQ is less than an hour from my house.

I am so sorry this is happening to you, and I have not had time to read the entire thread, but here are my 2 suggestions: (1) Start a new thread under ebay and paypal, asking all tpf members screwed by ebay and paypal to maybe post a short blurb about what happened, contact a good litigator with experience in class actions, and hopefully get them to review the stories, and see if they would be willing to take on your case and others with similar injustice at the hands of ebay and paypal, and certify a class. It seems like they are practicing unfair and deceptive business practices, and they are essentially refusing to hear both sides, and seem to be perpetuating the fraud committed by these buyers, by failing to give you your opportunity to be heard; and (2) see if a tpf-er who may live close to her sees her carrying your bag, which I am sure she is (since her intent has all along been to scam you out of it, I am sure she did not destroy it). Then, if a photo of her can be taken proving it, just turn the photo over, along with the fact that she signed the affidavit that she destroyed it, to Canadian authorities. Those would be crimes- lying on an affidavit, taking your purse- that would be burglary, and I am sure it is an international crime to enter into the transaction with the intent to deceive and defraud you. If you decide not to do option 2, at least if you get the photo of her with your bag, email her and tell her to send it back to you asap, or else you will take any and all legal action against her.

This suggestion is HILARIOUS and I bet it would totally freak the buyer out. Like, she'd be way scared.

That said, it might sorta border the line from angry seller to angry stalker, KWIM?
 
Wow, I'm so sorry to hear this. It's so hard to do honest business these days when everything seem stacked against you. I hope all of us here can help you in your fight to get your money back kristie.

I did..........BUT here is the thing. I wrote it a few pages back. The person that bought it has an Asian name and I initially assumed it was a female but I found out that 99% of people with that name are MALE. :wtf::wtf::wtf:
Now I REALLY have no clue who bought my bag...........I had visions of this bit$% carrying my bag around town and now...........who knows what is going on.

Not that guys don't carry Birkins but it is few and far between and usually size 40's.

He/She initially said it was a Mother's Day gift for their mom.
 
Which is kind of strange because California, if you actually get to litigation, tends to find on the side of the consumer way more than other states. I'm surprised they didn't choose Omaha.




I'm sure they would have loved to choose Omaha, but legally they are residents of Santa Clara County, Calif. and have no choice about submitting to jurisdiction there. ;)

After reading HARPERCASSIDY's thread...it wouldn't matter if the scammer was caught in the act of carrying the bag.
What ever happened to common sense...dead and buried, I guess.
 
This transaction was not on ebay. Buyer and seller took the transaction off of ebay, which is part of the reason why the sellers photographs and feedback were not a part of the equation.

whatever your opinion of ebays policies, in this instance ebay was not part of the problem. Other than by association with PayPal...But this was a private party transaction on paypal only, not ebay.

Kristie, did you have to fill out a customs form?

^ I wish people would wake up to the reality of eBay and STOP SELLING on that venue.

If this post and the insane number of other scammer threads in this forum fail to rattle people from their eBay complacency, I guess they'll have to become victims themselves.

OP, the nightmares get bigger all the time. I fervently hope you are able to recover your money or at a minimum, a healthy portion of it.

I see what you're saying. No matter what, someone may try to cheat the system at some point.

This is what makes eBay so scary! There's always two sides to a story, and from there, always 2 or more POV's from either side.

That would be quite the Mother's Day gift - I can only hope my unborn children are that generous! If it is a male, it pretty much guarantees that he will try to resell at some point. Hopefully everyone keeps their eyes open for the bag. Sorry if I missed it, but did you give specifics of the bag here? I'd be surprised if he tries to flip it right away, but I wouldn't be surprised if he tries to cosign it or have a friend sell for him.

I'm just so used to using eBay & PayPal interchangeably that I forget OP didn't sell on eBay! But the sale was initiated through eBay. That's how the buyer found the item, and then they agreed to use PayPal alone.

I think we keep saying eBay because they're BOTH just so darn evil! lol
