The attorneys can weigh in on this but it's the county you are in and where you do business that has jurisdiction. They must have some other operations in Omaha. You can get a venue change, though, if you go to trial.

Not a lawyer but work with contracts all the time with people in other states. I would guess the Paypal agreement that one signs to have them as a provider of services would have a bullet point somewhere stating the paypal jurisdiction would be CA.

They also might have something that legal issues will be settled by arbitration & not a lawsuit? Which is not a negative to you.

I would send the letter to the VP of risk & VP of legal counsel also.
 
Well, this is the thing, isn't it?

She actually only submitted evidence that a bag in her possession (or that had been in her possession) and/or shown in her listing pics was authentic.

Similarly, the buyer only submitted evidence that a bag in her possession (whether the one shipped from the seller, or not) was a fake.

The rest was taken on trust, because only the buyer and the seller ever really know what has happened, in a situation like this.

Well, I don't think they define "trust" the way I do lol. I would not trust a buyer with no history on my site, but I would trust a seller who has paid me fees on $120K. Not only would I trust that seller, but I would kiss their butt, and want them to keep coming back! Hell, fees on $120K would pay (part of) my tuition! They should have trusted the seller.

I am "lucky" in one regard.......I live 45-60 minutes away from Paypal corporate in Santa Clara County.

I want to show up at their office but I would probably have to be escorted out by security, LOL.
 
Okay.......I am on the phone with Paypal and they say there is no such THING as an "ambassador."

So now I am waiting to speak with a different asshat supervisor that will probably tell me the same thing the other one did..........

That's strange. They ANNOUNCED this new position as the Las Vegas Sellers Meeting last month. It's also been posted on the powersellers board on Ebay.


I'm going to see if I can find out more about this by emailing a TSAM. Does Pay Pal even know that Ebay personnel are announcing this??

I spoke with a claims rep and a claims supervisor and they both argued with me that there was no such thing. Personally I believe nothing they say and value what everyone here has been telling me much more.

They were so RUDE too! I know.... Surprising right?
 
Kristie I'm just seething when I read this thread. If we could mobilize everyone, I think you'd have a rabid army of pursies here of a few hundred, at least. I can't even type what I think of Pay Pal. I think everyone who transacts business online involving money is going to have to keep supporting other companies - like Google Wallet. There needs to be more competition so everyone can stop using Pay Pal completely.


My other suggestions are, besides contacting the ones at the Pay Pal sucks site, also write to Ina at Auctionbytes.com - she covers Ebay and Pay Pal news stories. I bet she'd be very interested in what is going on here and what you've been told.

Also the advice to file with the BBB is a good one. There have been many, aggrieved by Pay Pal, that have filed complaints and then gotten their money back from Pay Pal. I don't think that will happen - but it's another thorn in their side.

You also should file with with a complaint against Pay Pal with the California AG's office and also the feds - banking authorities or the Department of Justice in DC. The government wont investigate Pay Pal and how they do business (as an unregulated bank and escrow company) until enough people complain. You can (and should) also contact your local senator and congress person - make a written complaint to them asking for help - let Pay Pal ignore a letter from a US senator. More likely they'll get subpoenaed before a house committee.


Pay Pal truly needs to be treated like the awful criminal enterprise they are. Many former employees are out there telling horrible tales about abuse of power, abuse of confidential information and security breaches that to this day Pay Pal denies. I don't believe a word Pay Pal says. EVER.
 
April, thank you so much for all the advice :-) You know what is hilarious? Well, not really.... but at this point I am delirious.
I have no idea if this person is even a girl as we all assume, LOL
They are Asian and when I google the name, it is 99% males. The whole story when he/she bought the bag was that it was a Mother's Day gift for their mom. I assumed it was a female just because...... Now, who knows...... Not that it has any relevance. Just goes to show we don't always know who or what we are dealing with!
 
Kristie, all I can say is, I know exactly how you feel, to be out that much money. While I have never been scammed on eBay, I have had times when I was "cheated" out of my money. I just spent the last 1.5 hours reading through the whole 29 pages, and I am 10x more furious now than I was when I first started reading.

To repeat what others said, I really think you should try the Better Business Bureau (BBB). It seems that you are in California, and so is Paypal HQ, so I'm thinking that being in the same state "strengthens" your BBB case. That, and the fact that this case invovled $11K.

Also, and this may be a far reach, but what about contacting Hermes? You could contact the store nearest to you. Explain your case to them...perhaps they will have sympathy or empathy and lend you a hand.

I know this sounds like a reach, but please hear me out.

We already know that Hermes does not like eBay because of all the fakes that tarnish the H brand. However, I think that Hermes has a slightly better relationship with resellers who sell authentic H. (Although Hermes probably prefers people to buy directly from them, rather than secondhand.)

Since your case involved a fake H, perhaps you can somehow make this relevant to Hermes? That is, maybe you can find some way that they will have a stake of interest in this case.

This sounds crazy but I was so upset and this is what popped into my head.

Unfortunately, Hermes is very, very against reselling their products and it infuriates them if it is sold at a profit. They would never help even a really good customer with anything like this. They are very hands off KWIM? I wish it were not so but they would truly be the last ones to help unfortunately :-(

Which is kind of strange because California, if you actually get to litigation, tends to find on the side of the consumer way more than other states. I'm surprised they didn't choose Omaha.
