Just spoke with one of my pre paid legal attorneys.

He said if I did file suit against PP it could only be for a matter of contract. He said his concern is that this buyer was aware of a PP loophole that leaves me hanging out to dry regardless of how wrong it is.

I have to fax him all of my info I have, he will review it and refer me to an attorney in my area. I will have to pay full legal fees as none of them work pro bono.

Eh...I would ask another attorney. Maybe if a couple say the same thing, but since their terms of service were already found "unconscionable" in Los Angeles, I think this is a matter of finding a rabid dog of an attorney who wants to make a name for himself/herself.
 
Small Claims Court is not a bad route. If the OP can put in the legwork, there might be benefits.

I was once scammed by a seller, and I went to Small Claims Court where I won everything back.

Please keep in mind, however, that there are two challenges. The first is winning. The second is collecting. I spent more time trying to collect the damages that I was awarded that I spent gathering information and heading to court. Be prepared to research the methods involved in collecting, as well as challenges involved in international collections.

I agree. I would write to the BBB; although, I am sure they already have mountains of complaints against PP, but this one takes the cake.

I would write to BBB as well. When I was scammed by a dentist I won the case. They are forced to put everything in writing which could help your case
 
Oh no, PP now has a "protection plan" for buyers, just like Ebay's. That is how my scammer got her $1100. Did a PP SNAD chargeback saying bag was "heavily worn and damaged" -- after receiving it and "loving" it and keeping for 2 1/2 weeks. God only knows what pictures the weasel sent PP for her "case." From another seller she scammed similarly,(where she also changed her mind after carrying and using bag and then filed "heavily worn and damaged" in her PP chargeback), it is suspected she sends doctored pictures to PP. IF she even sent them any pictures at all. I think it is only buyer's protection nowadays on Ebay and PP, nothing for sellers. This is a huge loophole.
But at least I did get my bag back. Even if there was gross white pet hair all inside the bag, I was so thankful to get the bag back.
Kristie is out the bag and the money. Very tough. I hope a lawyer will help her get this figured out.

Thanks for clearing that up mmmsc.... I had no idea... and I am glad you got back your bag even if it is not in the condition it was... I have to say unfreakin' believable.... I am so sorry OP for all that you are going through. This buyers protection with lack of sellers protection basically make ebay impossible to sell on.
 
I do also think that getting the local authorities involved would be a good idea.
The local authorities where I live and she lives will have nothing to do with this. It is strictly a civil dispute. I have been in law enforcement for 13 years..... Reports are not taken for civil issues. As "criminal" as this, it is not in the eyes of the law, it is a civil case.

Maybe she was using an alias though. Didn't think of that. This story sends shivers down my back.

A Rabid dog of an attorney will cost me a retainer and fees that I just plain do not have nor do I have the means of getting.

This is mail fraud in an amount over $10,000. I am taken aback that this is perceived as strictly a civil issue. There is a contractual issue between you and the buyer and PayPal. But her actions to get the bag certainly strike me as criminal/fraudulent.

Oh My Daiizz!!! This is so so scarey! This happened to me with a balenciaga bag! Ebay took the side of the buyer without taking into consideration any of my evidence (i even had video footage showing the bag).
In the end, i lost out.
i'm so scared now. people might start doing this on purpose. In a way i'm really thinking, should this post be up on here...? it might tempt people who weren't even thinking of doing this to try it? :-(

It is not mail fraud either.......it is a civil issue. Period. End of story. I realize you are trying to help but what you are stating is simply not accurate. I DID contact her local law enforcement and was told exactly what I already know because I do it for a living. In the eyes of law enforcement it is civil.

Additionally mail fraud, which it is not, is not handled by police. It is postal inspectors that work for the post office.

As criminal as I know it sounds because it is in a manner of speaking, it is a he said she said case essentially between 2 people. I say I sent her a real bag and have proof. She says I sent her a fake and supposedly has proof. It is simply not a criminal case as crazy as that sounds.

I know. I tend to agree this thread is only giving bad people good ideas. I am so sorry you were scammed too :-(
