I am appalled by the new User Agreement. How can PP can blindly believe the buyer ???

Last month, I purchased a clutch from ebay; there was also a security tag that said: "This merchandise remain a property of xxxx until removed". I thought it was a smart idea.
But after reading this post, I'm a bit skeptical.
If such propperty right tag stay on the item, can the buyer still destroy the item??? IF they can, there is seriously NO WAY to self proof yourself, as a seller...
I'm, again, sorry that this happen to you, OP.

This makes me so sick and sorry for you - these scams keep getting worse and worse. Im hoping this is not the end of the story and you that you get some sort of resolution that you are happy with - not just this load of crap from Paypal! ....xoxox

OP, I'm so sorry to hear about your problem, it's just sickening.
I'm wondering if any of the sellers who have been scammed have considered sharing their stories with the competition of PayPal - Google Check Out- to expose them, rather than a news outlet. The competion would have a LOT to gain by exposing PayPal's shortcomings and would certainly have deeper pockets and better resources than the average consumer.
Just a thought. There's more than one way to skin a cat!

Just google "Paypal lawsuit."

this is just horrible..but I can't figure out how you're out 20k...you are just out the bag, right?

She paid you 11k, and then paypal took that 11k and gave it back to her, right? So you don't really lose 11k and the bag, you just have to refund her payment and be out your bag, right? Or did they give her 20k...refund her 11k that she sent and then take an additional 11k out of your account?

That doesn't make sense...you need to contact pp immediately if that's the case. The most they could do is refund her payment..they shouldn't be able to refund her payment and take 11k extra out, right?

I think the seller was saying this figuratively. 11k for the sale price, and 9k for the price she paid for the bag? So technically the seller is out 9k. Either way, I definitely feel for the OP. I'm so sorry this happened.

Of course! It's disgusting! And scary and horrible..I just think she needs to make sure that she is only out 9k and not 20k, because if they did take additional money after the refund, they made a big mistake!

If you read the entire thread I did say this multiple times. This thread is getting crazy long so it is hard to follow. I am not trying to lie and say Paypal owes me $20k. They owe me $11k. I worded it incorrectly when I first wrote it and it was too late to edit it.

My bag cost me $9K. The buyer paid $11k and was refunded $11k; Therefore, they owe me $11k.

lol...i was just reading the whole thread and came back to correct myself..didn't realize this had been cleared up already! I was just so horrified by your story that I posted before reading everything.

Have you had any contact with this person? Do you know their name..address etc... Do you think that if you threatened with lawsuit, letter from attorney that she might relent?

The original link for the auction is expired. It was an auction that was a BIN or BO and the bag did not sell for a couple of go arounds. I decided to not relist it and then relist after some time passed. Prior to relisting, the scamming buyer contacted me about the bag because it had been on her watch list and she said she was still interested......so it went from there....... Trust me, if it is out there I will find it. I truly don't think she is dumb enough to sell it herself on eBay or give it to a major reseller to consign. She clearly knew how to work the PP system very efficiently; therefore, it is my belief she is keeping it. I think she wanted an H bag, could not afford one, and figured I would not miss my $11K loss.

OMG I am so sorry Kristie :( While all of the scams have been horrible, this one has my blood boiling like no other. Basically, Paypal is allowing any criminal who wants a Birkin to easily get one for free. Seriously, when will there be a class-action lawsuit against Paypal to end this for good? This is just disgusting. Paypal thrives on taking money from good people and making a profit from it, all while allowing criminals to live the lives of luxury. Soon, we'll be seeing homeless people on the streets with Birkins with the way things have been going lately. This is just insane. I really hope you find a way to sue Paypal for this. You presented them with legal documents certifying authenticity and they disregarded it. IMO, that is grounds to sue them, especially since they won't even give you reasoning behind their decision - which makes it seem like they didn't even look at your evidence.

I absolutely agree.
I truly think I have no chance trying to win anything from this buyer as the evidence for a civil hearing/lawsuit has been "destroyed."

My best shot is suing paypal for ordering destruction of an item that
1. Was proven as authentic by me, the seller.
2. Ordering the buyer to destroy property not belonging to them.
3. Taking the buyer's side in an essential "he said, she said" when I provided more than sufficient documentation of authenticity.

TOTALLY agree!

You know, I 've been a paypal buyer for years. Just to be clear, their service is just as sh*tty for buyers than for sellers. But this case takes the cake. I never realized just how risky all this Ebay stuff can be. I feel very, very, very bad for you OP. I could almost cry for you. What a complete nightmare this is. I hope that you are at least sleeping at night.
