Sorry to hear you had to go thru this. I got searched in 2019 too. Just wondering if they have continued to pull you out for inspection on every trip afterward. Some of other comments mentioned that possibility, which makes me feel very nervous. Wonder if they would insisting on going thru all luggages even if I fly back from Asia and with no shopping/food items.
Can you elaborate more? Was the person being held for examinations every single time after that incident? Or it only happened when coming back from Paris/EU? Thanks.

I will add that I believe what @lulilu was saying is that if you are caught cheating customs, you are likely to get stopped every time you enter the country. You may well lose your Global Entry privilege, etc. But we all know this...if you break the law, you are of course subject to scrutiny.

Thank you! Last time I declared and in the end paid duty, but still had to go thru full bag search. I was 7-month pregnant and with my 3-yr old and senior mom. It took more than an hour and we almost missed the connecting flight. The male and female agents were very rude. They even checked the dirty clothes laundry bag. Not sure if we were singled out. It was a terrible experience for us.
 
I recently bought an H bag from UK and the package was checked by US custom. After I paid 10% on the original purchase price of the bag (invoice dated 10 years ago) and it was sent to FDA review. Anyone has any idea why a used leather bag, not even a FDA regulated item is being sent to FDA for review?? I couldn't get anything from google and DHL is not helpful at all. Any insight is a appreciated.

FedEx required to fill a form for appeal and they will submit on your behalf. I followed their procedure and was informed about a month ago that the form was submitted. But I haven’t heard anything back yet. Will keep you all posted once there is a new development.

I will share a little more on my experience .
I have had a few things shipped — canvas bags, leather bags , wooden jewelry box, crystal glassware, art . What I have discovered is duty is computed by the carrier who brings it into the country . The carrier determines that duty based on the description provided by the shipper - which determines the items category - and “The US Harmonzied Tariff Schedule “ (HTS) - which provides the duty %.


I have spent time going through the HTS — it is a huge document that covers duty rates for every category you can think of.

Sometimes the shipper doesn’t provide a good enough description for the carrier to determine the duty % from the HTS and additional information has to be requested from the shipper. For example in my case, additional information was requested from the shipper about my wooden jewelry box— more detail was required on the types of wood and the origin of the different woods. Unfortunately , the shipper did not answer quickly enough so the carrier sent the box back to the shipper and it took weeks to sort things out.

Sometimes the carrier makes a mistake in their calculation. When I shipped crystal glassware it wasn’t described well in the shipper’s description and was classified in a category of regular glass with a rate of over 20%. I went through the HTS and found the correct category , which was around 3%. After the carrier confirmed the correct description of the type of glass with the shipper, the rate was changed to the correct 3%.

It seems to me there is a lot of opportunity for error. Both in the shipper’s description (typically not enough detail ) and the carrier’s calculation of tariff . You can ask the carrier to provide information on their calculation if you have any questions.

When I had a shipment of only handbags, both leather and canvas, they have always been taxed at 9%.
thank you so much, @sbelle. I was wondering too when I first got the bill. I actually have never paid even that much at airport custom. Typicall, I was charged 3% and I got the same agent on several occasions to a point he recognized me. I magically found the bill. I thought I tossed it. I will give a call when life gets a bit quieter. Will keep you posted.

Are you saying that you when you were at the kiosk, you didn’t get the screen with all the normal questions (eg foodstuffs, currency, commercial merchandise) or was it that all the other questions were on the screen to be answered, but not the question regarding the value of goods purchased?

Because if you weren't asked any of the normal questions, I would guess it was a glitch. They are very serious about every one of the questions, so they wouldn't skip them on purpose.
we did not get these questions either. I’m global entry/TSA pre/ and CLEAR. I was confused bc I’m used to filling out the form the old way for many years).
 
yeah, we will see how it goes. I would not mind getting the money back. But I wouldn’t bank on it. we all know where it will go :smile:. I do however love the bag and am grateful Hermes shipped it. the customer service was superb!

After reading some of the posts, I hope someone can answer my inquiry. So, if someone gets caught not declaring their purchased items abroad, and then end up paying the tariffs or fees… does that mean every time the person travels back to the US, s/he will get flagged for secondary inspection? For how long? That’s one huge nuissance.

My friend gets flagged and inspected every time since she was caught 4yrs ago. She got off lightly and now declares everything. It couldve been worst as CBP can confiscate all of your items and issue you a very hefty fine! Now they say thanks for you honesty and sometimes lets her go or sometimes charge her duties.

confiscating is the worst. Imagine trying to get your holy grail bag only to be taken away after all the hard work. Oh so she gets through the second inspection every time after the incident? Huge hassle especially with a connecting flight. Wonder when they’ll stop.
 
Someone I knew brought with $10k plus some change (less than $200) in the wallet. They flagged him for not following the rules of $10k and threatened about global entry access. But it was an honest mistake and he hasn’t been flagged since. I suspect that it depends what you get caught for. I personally declare since it is so much cheaper than what I paid to FedEx.
As a quick update to my appeal, I haven’t heard anything since. It has been 3 months. I don’t bank it to be my Christmas gift.

Oh he brought in more than $10k in cash? I think that’s a lighter charge than not declaring the goods you purchased overseas and getting caught. And yes, FedEx is by the book when it comes to their charges. good luck.

While waiting to declare and pay whatever the CBP deemed, I had a long discussion with 2 of the agents (maybe 4/5 years ago?), after they had told me "thanks for your continued honesty, and please just go through".
1. Yes, you are on their radar for the foreseeable future, and if they want to make your life miserable, they certainly have the means and temperament to do so. Cross them again and you're doomed.
2. Check the us gov website.
3. Do the math prior to purchase, figuring in the max customs, VAT, exchange rates etc. Assume that's your end price point. Then, if you end up not paying the duties, it feels like a gift!
4. Make whatever decision you are comfortable with, but I'm not sure I understand the need to lie or cheat. You bought what ever you did, you will love it and it will always remind you about that particular trip. That's a wonderful thing to have, why add a coda of unpleasantness that will always persist?
