why don't you call up Rue lala and ask about the tax

what you are saying is tax evasion/tax fraud

state tax goes to all the state services that a state provides and collecting the tax and not paying it, is illegal

Ruelala should not be charging sales tax in a state where they have no physical presence...i.e. a distribution center, business office...etc.

I agree that a phone call is in order to determine if this is the case, or if the charge was in error. Please let us know what they say if you do contact them.

I called them and they say that they are willing to cancel my order, but they hire a professional to do their tax, and they are pretty sure that those people do it right, so there is nothing they can do about it. I'm not satisfied with the answer, but I figure it doesn't worth my time to investigate further.

Hmm...doesn't sound like the person you spoke to had a clue really. They didn't even answer your question!! :cursing:

Perhaps you could try and speak with someone else...

I agree that I think it would be some kind of fraud if they claimed it was taxes and it was not used for taxes, so I doubt they are just trying to mark up prices.

I also just checked online and I didn't see anything about a change in the internet sales tax law, so I would not be satisfied with their response either. If there is no physical presence in WA they should not be charging you a sales tax unless there is now a physical presence, in which case they should be charging you the state rate not a higher rate.
I would guess this is some kind of computer error. Some states are now being strict about use tax laws but I'm sure that there would be a news story about it if there was some new internet sales tax law that crossed state lines. I would try calling again and see if you get someone else.

ETA: saying internet sales tax law is not exactly correct. There hasn't been a change in the lack of internet sales tax law? or a change in the supreme court decision? Sorry, not a lawyer if I'm wording this improperly!

I think they have an office in Washington. I know that their Main office is in Boston, Mass, and their main shiping place is in Kentucky (from my packing slip.) Based on Rue Local, my guess would be Seattle. I searched for Rue La La in WA. I just bought a Ghurka for my sister and wanted to know why I was charged tax. I found their address, and this forum, so I thought I would share.

They probably should only charge sales tax if they have a physical presence in your state. Even then, they should be charging whatever the tax is in your state. Did you ask them where that 10.27% came from?
AFAIK there is no internet sales tax, but several states do make amazon charge sales tax and more are considering.

In 2009: Retail Convergence, operator of private sale website RueLaLa.com, acquired by GSI Commerce for $180 million, plus up to $170 million in earn-out payments based on performance through 2012

GSI Commerce has an office in Bellevue, WA therefore required to collect sales tax on WA purchases
