There are many companies that have financial challenges & they are usually addressed in a professional manner.
When the communications that have been going back & forth & with the state of CA asking
for specific information & @YGR is still to a certain degree is getting the runaround, there are
just no excuses for that. JD has store in Paris, 54 rue du FSH
JD received 7 millions euros a short time ago from KAIROS.
This is just unacceptable.
Maybe they are confused with the duties, sale taxes, and use (importer taxes)?... 3 different payments in addition to the bag. The importer tax (use tax) is not always charged and I think the state charges that at random (not sure how it works). So a costumer might end up paying those 3 charges (duties, state tax, importer taxes). Maybe JD is confused??? and hopefully they’ll figure it out soon. I really hope they figure it out soon.

Duclos does not appear to have a seller permit # & JD seems to be circumventing & deflecting to DHL ..

where is that state tax going that JD collects?
Clearly JD says on their website, "all taxes & duties are collected at the time of payment"
So putting some pressure with various sources that @YGR may be pursuing, she may get her refund

I don't believe JD is confused. My invoice breaks down cost of the bag, custom duties and CA state sales tax. The issue is only related to CA state sales tax. I checked it all with the State myself. No other taxes are in question here.

I spoke with the State this morning and learned that there is no difference between sales tax and use tax....
For example: if i buy a lipstick from Macy;s today, I'll be paying CA sales tax and Macy's will remit it to the State. The same rules applies to all vendors (including JD), where JD charges their customers a sales tax at the time of purchase. However, when State communicates with me, it becomes a use tax.... it is the same substance but it changes it's name. I know, it is confusing...


from JD stand point it is always a State Sales tax and all communication states so.


Vendor - State communication terminology is a Sales tax
State - Consumer communication terminology is a Use tax

I see what you’re saying, what about the people who buy from known brands like Farfetch etc and pay duties, state taxes and then their packages are held until they pay importer taxes? That’s what confused me, I thought that above certain amount $$$ you might have to pay importer tax (use tax) in addition to duties and state tax… but who knows… Maybe someone who has been through it can chip in?
 
Can you try calling DHL Express and ask them for a copy of the invoice that shows the taxes were paid to DHL by the sender? DHL would be the one billing JD and then remitting the tax.

To make things easier for you, DHL Express offers a service to pay these Import Customs Duties & Taxes on your behalf to government authorities when your goods arrive in the country.
There are two options:
  1. If the shipper has pre-selected the option to pay for the Import Customs Duties & Taxes, then no further payment is needed from the receiver prior to delivery.
  2. If the shipper has NOT pre-selected the option to pay for the Import Customs Duties & Taxes, then the receiver will be charged prior to delivery.

Thank you. I talk to DHL. DHL pays customs duties but they are never involved with State Sales tax. State also confirmed that. ‘Customs duties & taxes’ are not the same as state sales taxes.

I have my DHL express bill (JD provided it to me last week). Dhl bill state that taxes are paid and provides account number. State checked the account number on dhl bill against their database, and no answers were found. Sadly. Thank you for your help.

@YGR purchased this bag in July 2023 so the state notified her that the state sales tax was never paid

CA state rep says that there is no record of JD in their database so no one knows where
that state tax is & JD is not cooperating
@YGR has an itemized invoice from JD showing paid tax & duty

Hello! No, my DHL delivery went smoothly. I'm in San Diego, so Long Beach was a port of entry and US custom. For some reason (maybe random, maybe because order was over $5K... or who knows why) custom notified State of CA about this purchase. I placed online order with JD in July 2023. In March 2024, I got a letter from the State of CA stating that I might be responsible for State sales taxes for my international purchase, if i don't believe i'm responsible, i had to fill out State paperwork (online) and provide proof that sales taxes were paid by me. I did do that and provided JD invoice (in paid status) where custom duties and taxes were itemized.
However, State of CA is unable to find JD as a registered agent who should be remitting sales taxes collected from the customers back to the State. Per State, they reached out to JD for more information but no information was provided, therefore state is going after me (the consumer) to receive sales tax. I kept communicating (very transparently) with JD and State (all 3 parties (including myself) via multiple emails since March 24. JD is aware of every letter and email State addressed to me. As of today, there is no resolution.

A recap.. JD is just blatantly not being cooperative.
 
I also confirmed that DHL that the only fees which DHL pays on behalf of the company is custom duties. DHL is not involves with State Sales taxes or any other taxes.
I don’t care how beautiful their bags are. I would not want to transact business with this company for any reason, and I’m sorry you have to put up with this. I’m also sorry to see a company like this, who is supported by TPF, act in this fashion.
 
Having allowed this situation to go on for this long, and having stonewalled the client, all over approximately $500, I can only conclude that this company is done. As Duclos is a new enterprise, they have no reputation to rely on, and a simple internet search will reveal all of these unseemly details. It’s hard to imagine anyone choosing to do business with them under these circumstances.

ETA: @YGR , I’m glad that at least the California revenue department is trying to help with this and not treating you as the villain in this matter.

I just want to point out that this one issue has completely dominated this thread since July.

Personally I have had great experiences dealing with JD and view this episode as not typical.
