No, if the seller is agreeable to the return, you may return it but be sure to use delivery confirmation (or signature confirmation if the total price you paid including shipping was $250 or more) and if the seller reneges on her promise, you can file and prove the return.
Is the seller agreeing to refund your shipping, hopefully in both directions? IMO, in the case of SNAD, the seller should make you completely whole since the return is due to her error.
If a seller is in agreement, do not file a claim. Claims count against the seller. That is why they are willing to work it out.
Hi, I place a offer on a item on Ebay the seller stated she would like more for it but will consider my offer which was only a few bucks different, well she accept the offer right before the offer expired yesterday. I haven't paid yet but I saw the same bag listed by her on Craigslist and still active. I inform her about my concern and her response was you won it on Ebay. Am I wrong for been concern?
I wouldn't worry about it as long as you get the item as pictured. Once you've paid for it, she's obligated by ebay policy to complete the transaction.

I should have added that since you can't force her to send something (for example, if she gets a better offer on CL, you can report her as a non-performing seller and can leave feedback.Ok thanks
Thank you for your advice. I did ship the dress back to the seller by USPS Delivery Confirmation and she received it last Friday. I still have not been refunded. She told me once I remove the negative feedback she will refund me. She also is stating that the dress is as described in the auction and it is not.

She does NOT deserve a positive feedback and if you want to leave the neg as is, I don't see any reason why you shouldn't. This is feedback extortion. She cannot hold your refund hostage unless and until you revise her feedback.

This seller is getting on my nerves, a attempt was made to deliver the package and no one was home so a notice was left to be pick up at the post office seller is saying she doesn't know when she can pick it up. I should have open a claim. I think she is stalking because she doesn't have the funds to refund me. Very frustrating.
Contact ebay and explain that she's not picking up the package and therefore not issuing your refund. Tell them you want your refund and they should issue it.
And leave her a well-deserved feedback!

Beenburned, thank you so much for your advice. I did open a dispute, since this seller is not keeping her word. I can't believe I fell for her promise to refund me. I will not be changing the feedback I left her now and she had also left me positve negative feedback, which ebay removed. Hopefully I will get my refund today.
