I've been following this thread and wow ... this guy is unbelievable!:wtf:

Choo_girl123, I commend you for your professionalism and patience in dealing with this buyer. I do hope everything gets resolved soon. Hang in there!

^Interestingly, I just noticed that my transaction detail page (on *bay) now states "you have 0 days to open a case" and if you click on the "report a problem with this transaction" link you get a page that says something along the lines of you've exceeded the time period in which you can open a dispute; talk with the buyer to resolve your difference. Huh. Does that mean the buyer can't do anything to me (eg, file item not received/chargeback/etc)??

Yes I think there are a certain number of days to file a dispute (90 or 60 or something) - after that paypal will only respond if he files a credit card chargeback.

I don't think you can... BUT if the 45 days are up, he's too late to open a PayFoe dispute. If he paid via a bank transfer, well, good luck to him getting his money back. If he paid with a cc, how long he has to file a chargeback depends on his cc company's policy. Even if he does, the cc company isn't PayFoe. I believe you have enough proof to win a dispute with his cc co.--as long as you still don't have the item, BTW, is his fault, too. Based on his correspondence with you, I don't think he would be able to prove he didn't authorize the charges. He can't prove the item was broken or defective because he never had it in his hands. He can't prove he didn't receive it, kuZ there's proof the item arrived and he refused to pick it up. He could try the customs charges BS, but don't cc co.'s know buyers, not sellers, pays the customs charges? Unless your auction stated that you would pay for these charges, I think he doesn't have much of a leg to stand on...

Excellent! Thanks so much for all this info. You rock!!!
I have no intention of keeping his money IF I get my item back & it's still in perfect, new condition. I do intend to deduct shipping both ways and my *bay listing/FVFs. I feel more comfortable doing this knowing that he can't fight me through PayP. As you said, I am confident that I can prove to the CC that I held up my end of the bargain.

Hmmm ... if this goes on for another 15 days, he won't be able to leave feedback, either, so he can't hit me with a negative. Too bad - I would have certainly enjoyed seeing his "wordy" comments.

I'm keeping my fingers crossed for you, choo_girl123! I showed this schmuck's comment to my PHH and his comment was, "Who in the world writes like this these days?" I seriously think this guy must've just used a thesaurus to replace every other word to sound more intelligent.

Sorry it took me so long to respond.
Technically when the package somes back it may state "postage due". If you recall there was a little option on the customs form on whether or not you would like to pay for return shipping if the item is unclaimed.

Still no package back? I hope it takes less than 6-8 weeks to get here though.

^Hmm ... I honestly have no recollection of the custom's form, so who knows what I checked. I know I said that I wanted it shipped back to me if the item is unclaimed. Hopefully, they'll just notify me that it's at the post office & I'll just need to pay to get it back.

For those of you who have been following this thread, I received this email from the buyer today:

Dear Ms. XXXXX,

I should like to wish you a happy new year and to be among the first to congratulate you and your fellow countrymen on your nation's new lease of life. Getting back to our business at hand, I see from the parcelforce website that the item's been despatched from the American hub and should either be with you already or soon to arrive. Please keep me updated on that so we can finally conclude this affair peaceably and amicably.

Kind Regards,

H. El-Rayah

I guess someone told him that he might have better luck getting his money back if he were a little bit less nasty, which is always a good thing. What I think is truly amusing, however, is that when I shipped the package to him (for $40+ dollars, with insurance and signature confirmation via Priority Mail) it took 11 days to get there. Yet somehow, he is under the impression that the package that was dispatched 'return to sender' from the UK on January 19th via 'economy' service is 'already with me' or 'soon to arrive'? Either he's an eternal optimistic or he's just delusional!

By the way, I XXXX'ed out the name in his salutation because it wasn't my name - he addressed his email to someone else, making me wonder if he's had a similar problem with another seller. Hmmm ....

Where's KZ...can't wait to see the response she drafts of how she would respond to this %*&$#. This is absolutely insane. To recap, (I followed the thread but need to be refreshed) where is the money? Is any money still owed?
