Hello me again Clueless here, :) I would love you to take a peek at our new authentication disclaimer, I worked with another moderator and I hope you all think its better. We took your concerns to heart and I hope you all like this one better.


We are trying to keep the fakes off the site. Submitting a support ticket may be a good solution using the descrption "Purse forum Report" or ?? not fake though.. we have too many junk listings that are reported that way.. We want your reports to stand out.

Thank you for your quick feedback. I tried to take one of the purses back tonight and the manager in charge said it was perfectly legal for them to sell fake Coach bags because it was donated to them and they did not state that it was a Coach bag when they sold it. She offered to do an exchange but I had to find something totalling the full amount the same day. I couldn't find anything totalling that amount and that was the cheaper of the two purses I want to return.

So now I don't know what to do. Do you know where I can print out something that states that it is illegal to sell fake designer bags even if it was donated and you didn't state that it was a Coach bag? This is a fairly large chain. Should I try to send something to the corporate headquarters? Should I contact the state Attorney General?


Both are fake. Take them back and demand a full refund - selling fakes anywhereunder any circumstances is illegal.

I also STRONGLY suggest you carefully read my 3-part Fake Serial Numbers list posted in another thread, and print it out for reference when you shop. A quick reading of those posts would have pointed you to several obvious red flags in both the bags you bought.

This bag has an always-fake silver tag, doesn't matter whether it says USA or Italy, they're ALWAYS fake. The number 6094 on the tag is one of the most commonly-used style numbers on fakes.

The C pattern is off-center, C-pattern bags shouldn't have C linings, and that fake patch on the inside with just a Carriage isn't anything Coach ever uses. The hardware is all fake, Coach straps shouldn't have the name Coach woven into them, and the flap on the front doesn't even look like it's centered corectly.

Whether or not the seller discloses that the items are fake doesn't mean a thing. The law is written to protect the Copyright or Trademark holder's rights, not the buyers. Anyone knowingly selling something with a legally recognised trademark that was NOT made by the owner or licensee of that mark is in violation of the law. You may want to print out the following and tell the store manager to have a competant lawyer look it over - THERE ARE NO EXEMPTIONS FOR CHARITIES, DONATED ITEMS, NON-PROFITS, etc.

And yes, I'd send an email or snail mail with the URL or a copy of the actual law to their corporate HQ. I don't know why all these non-profits think they're exempt from obeying federal law but that's NOT the way it is.
 
I think this may be the first fake Kristin I've seen. I'd like confirmation from our other posters just to be 100 percent safe and I'll also post this at the reporting thread but it's always good to know what kind of junk is floating around in Ebay Hyperspace.

It's a surprisingly close fake except for a few obvious mistakes, including a bogus serial number and a style number 12988 that belongs to a fabric Crossbody, pic below, although all the fakes-selling sites seem to use it for a Holly print Madison. I'd guess that the seller has been warned before that it's fake and is ignoring the warnings, the item description says "IF YOUR ARE IN ANY WAY DISSATISFIED WITH WHAT I SAY AND WHAT YOUR RECEIVE, PLEASE CONTACT ME VIA 'CONTACT SELLER' - (PLEASE DO NOT USE CONTACT SELLER 'ITEM NOT AS DESCRIBED').

Just a quick addition to your question, maybe the dimwits at the thrift will understand this example a little better...

The SAME law protects not only trademark holders of brand names such as Coach, Ralph Lauren, NASCAR, etc, but also Copyright holders of published works such as books, music, movies, computer software and all items protected by a trademark or copyright. It's no more legal for a store, thrift or private party to sell illegal and unauthorized copies of items where the trademark is owned by Coach or NASCAR than it is for someone to copy a company's copyrighted software or music cd or dvd movie and sell that or to donate them to their local Salvation Army store where they're resold, or for someone to scan and print all the Harry Potter books and donate the copies to their local thrift so the store can sell them.

It doesn't matter if you tell the eventual buyer that they're copies, the fact is that the companies holding the trademark or copyright are the only ones who have a legal right to sell those items. If ANY store, thrift or no, started selling bootleg or illegal copies of Microsoft software or Lord Of The Rings, those companies' lawyers would be on them like flies on poop. And screaming that they're a non-profit organization as the FBI or Department of Homeland Security leads their manager away in handcuffs isn't going to cut them any slack, the same laws apply to EVERYONE.
