You read of this happening so often you have to wonder if at some level it it is done deliberately out of jealousy. Read about disasters at the hairdresser, supermarket etc. people out dining with brand new Hermes bags that get damaged by careless waiters. I am glad she is suing!
I Don’t consider myself wealthy so by no means is this self adulation. How you are perfectly right in that some people have such disdain for wealthy people, it can’t be anything short of jealousy. I have heard people admit to deliberately parking their beat up cars closer to fancy expensive cars just to beat up the owners. Or people who intentionally compliment an expensive watch by saying oh wow, “nice watch, is that Calvin Klein” knowing well it’s a darn Mille or Audemars. All to piss the rich off. I won’t put it pass the waitress to had done that thinking the patron won’t do jack...while her lawsuit may seem frivolous, I disagree. I think it’s only being dismissed because it happens to be a handbag and people are bewildered at the thought of someone spending that much on a handbag. Still doesn’t diminish the fact that this is a loss to her and someone ought to be liable
 
It's good to see the lawsuit against the waiter was pulled. I wonder if the waiter in question still works there? I feel like that lawsuit would cause the whole staff a lot of unnecessary stress. Or even make them want to walk out. That's a extremely poor work environment to be in thinking sh!t if I make a mistake my employer is going to sue me.
 
Why did both sides need to get authenticity reports? And the plaintiffs supposedly have 2? Why not just produce the receipt/proof of purchase showing the amount paid? Maybe this is why the value of the bag and authenticity is being disputed...

I’m glad the countersuit against the employee was dropped.

Unless the serial # of the bag is on the receipt, a receipt in and of itself doesn't prove that the bag in question belongs to that receipt.

It alone may not be proof. I have no idea about Hermes receipts but you’d think to prove value they need to actually prove what they paid and that it wasn’t purchased on the secondary market at a lesser amount.

Should it matter what was paid for the bag in a lawsuit or do they use the replacement value? I would assume replacement value as you could take a huge loss on certain luxury items. For example, if you bought a Chanel 10 years ago for $2,000 and the current replacement value is $6,000, then suing for $2K wouldn't really make you hole.

Doesn't matter what you paid. The settlement would have been for fair market value and condition of the bag would also apply. This applies to a liability situation. I don't know how a claim against her Homeowner's Insurance would have proceeded, didn't work in that area.

It is not being dismissed by an Insurance Company because people are bewildered at the price of the bag. Maybe the club dismissed it and did not notify their Insurance Company.

Agreed. I would think an appraisal would be relevant here but these contradictory authenticity reports VS proof of actual purchase & appraised value make me wonder where this 30k # is even coming from. Of course we don’t have the full story & probably never will.
