I ordered a twilly, didn't think about it, just pushed no signature required. Well, long story short, UPS says it was delivered, but I was home, I have dogs that bark, and a video doorbell camera. No UPS driver was at my home. Fashionphile just keeps repeating that they take no responsibility for it. They also have an agreement with UPS to not allow their customers to make a claim. So, unless it appears, I'm screwed. I paid PayPal, and have filed a claim, but I don't expect there's much that they will do either.

Sorry that this happened to you. On FP web site it says more or less that by waiving the (orders under $500)
signature, the buyer accepts full financial responsibility for the item after the package leaves FP.
I'm guessing that you checked your video doorbell camera to indeed see if a UPS delivery was made
I would be as pro active with PP as you can be.
 
Yes, I freely admit I screwed up. I accidently checked the box, however, what burns me is that they have an agreement with UPS. The result is that they will not allow UPS to work with me to try to find where the package is. The video clearly shows no UPS driver at my front door, or anyone else. So, they won't even help me to try to find where it is, I find that to be strange. Why would they block me trying to recover the package? I live in a gated community, I've never had anything stolen, nor any of my neighbors, I have dogs that bark, I was home, and the video feed shows no UPS. I'm going to move on, and consider it to a a $200+ mistake, but I will never purchase from them again. I've informed Paypal of every call/email I've had from them, at this point, I don't know that there's anything else I can do, except to warn anyone else about what happened to me.

This sounds so wrong! I’m sorry for your troubles. Maybe not give up? They may have an “agreement” with UPS but that sounds like it gives UPS to conveniently lose a lot of Fashionphile’s packages. Kwim? I would keep pushing it with UPS.

Paypal hasn't been super helpful either, and as fate would have it, I used my debit card. So, at this point I realize I'm out $200+. I just don't want this to happen to anyone else. I personally have deleted all my "following" from their website, and when there are no options left, will close my account. I spoke with a neighbor, who has ties to the local police department (I live in a large city) and he said the whole thing sounds like a scam, either someone at the sender or the carrier.
 
I’d go down to your UPS hub, ask for Mgmt you can find out easily if that truck was at your home as they all have GPS tracking on them.
Also, an agreement between FP and UPS- urban legend?

Fashionphile has an agreement with UPS but you the buyer doesn't have that same agreement.
Why can't UPS provide a tracking number? Since you filed a police report, what makes FP
or UPS think that information won't be asked?
Perhaps that package never even left the FP warehouse
 
lucky you used paypal for the payment, even it doesn't work out with UPS or FP, you can always claim you never receive the item. you should get your money within a week or so. that happened to me before and it's a large amount, at last i got my money back no problem.

I should clear a misunderstanding. I have a tracking number, and it says delivered to my front door. However, I was home, I have dogs that bark, and a ring doorbell that shows that no ups driver approached my home. (There was no activity at my front door, so it wasn't stolen.) I have contacted UPS, but they will not give me any help in trying to find the package. Fashionphile's agreement with UPS is that in exchange for cheap shipping rates, they agree to not give the buyer the ability to file a claim, so UPS will not put a trace on the package. If it's lost UPS and Fashionphile deny any claims. So, according to a Dallas Police representative, the speculation is either that it was misdelivered, and whomever just kept it, it "fell off the truck", (knowing that it was not a signature required), or someone with the sender is in collusion with someone at UPS and it may never have even been sent. Either way, unless Paypal sides with me, and I doubt that since UPS claims it was delivered to my front door, I am out $200+. I've filed a report, and I'm just going to let it go and realize I won't make that mistake again. I want to share my mistake so someone else won't be in the same boat. I, nor my daughter or friends, will be purchasing from Fashionphile again. I sincerely hope that putting this story out there will help to insure that this doesn't happen again. I will say that Fashionphile's representatives I have spoken to have been condescending and read from a script in an increasingly loud voice, they don't answer questions, they just keep repeating that it's not their responsibility, and then one asked me, exactly what did I not understand? At that point, I decided that I didn't take that kind of attitude from anyone, and I was done. There are battles you can win, and people who just aren't worth your time, and they are in the latter.
 
If you want your money back, the easiest route in this situation is through PayPal. Unfortunately, Fashionphile’s site suggests that for items under $500, you can waive the signature requirement. Which means the buyer is fully responsible for any loss after the item leaves their warehouses :sad:. It’s great that you paid via PayPal as others have noted. Credit cards will also accept claims against lost items.

If you want the Twilly … well that may never show up because of UPS’s mishap. The best thing to do is to always require a signature for important non-Amazon shipped items and continue to get tracking. It’s a good habit to check the shipping and return policies of the site before purchasing. Unfortunately, ecommerce sites like Fashionphile are highly optimized for fast purchases. So discerning buyers have to spend some time to dig into the policies on their own. Insuring more expensive items is also an option. Good lesson to pay forward for next time.

It’s an awful situation though, and the folks on the phone should have been much more understanding!
