Daughter Sues Clinic Over Joan Rivers' Death

Melissa Rivers filed a malpractice lawsuit Monday against doctors and the clinic where her mother, Joan Rivers, suffered fatal complications during a routine medical procedure.
"What ultimately guided me was my unwavering belief that no family should ever have to go through what my mother, Cooper and I have been through," she said, referring to her son. "The level of medical mismanagement, incompetency, disrespect and outrageous behavior is shocking and frankly, almost incomprehensible."
She said her mother deserved better.
Joan Rivers, a comedian who crashed the male-dominated realm of late-night talk shows and starred with her daughter on E! in "Fashion Police," died Sept. 4 at age 81. The city's medical examiner found that she died of brain damage due to lack of oxygen after she stopped breathing during an endoscopy at Yorkville Endoscopy days earlier. Her death was classified as a therapeutic complication.
A message seeking comment that was left with the clinic's manager was not immediately returned.
The lawsuit said doctors mishandled the endoscopy and performed another medical procedure called a laryngoscopy on her vocal cords without consent. The suit said the doctor left the operating room to avoid being caught.
"To put it mildly, we are not just disappointed by the acts and omissions leading to the death of Joan Rivers, but we are outraged by the lack of care and concern for Ms. Rivers on the part of her treating physicians and the endoscopy center where the treatment was rendered," said her attorneys, Jeffrey Bloom and Ben Rubinowitz.
A federal investigation, ordered by the federal Centers for Medicare and Medicaid Services, found the Yorkville Endoscopy clinic made several errors, including failing to keep proper medication records and snapping cellphone photos of Rivers while she was unconscious. It also found the Manhattan clinic failed to get informed consent for every procedure performed and failed to record Rivers' weight before the administration of sedation medication.
The clinic submitted a lengthy plan for fixes, but the changes weren't good enough and the federal agency said it would revoke accreditation unless it was in better compliance by March 2.

Melissa Rivers walked the Grammys red carpet with her son following her mom Joan Rivers's posthumous win for best spoken word album. Rivers won the award for her audio book for Diary of a Mad Diva during the Grammys pre-show.

Kathy Griffin, who's replacing Joan as host of Fashion Police, tweeted her excitement at the win:

Speaking to Giulana Rancic on the red carpet, Melissa Rivers said, "It's a difficult moment. It's a little bitter sweet." But added, "It's wonderful how loved she was and how she's getting so much attention now."

Joan died in September in New York following complications during surgery.

Joan Rivers' lavish Manhattan penthouse is put on the market by daughter Melissa for a whopping $28 million

The late Joan Rivers' opulent Manhattan penthouse has just come onto the market for $28m.
The expansive property occupies the entire top three floors of a seven-story, turn of the century Gilded Age mansion.
The home is being marketed by real estate broker Leighton Candler of the Corcoran Group on behalf of daughter Melissa Rivers, following the comedienne's untimely death in September.

Top dollar: Joan Rivers' luxurious Upper East Side apartment is on the marker for $28 million

Joan once described the Upper East Side condo as 'where Marie Antoinette would have lived if she had the money.'
It was built in 1903 by millionaire John Drexel, with the building - located just off Fifth Avenue at 1 E. 62nd Street - being converted into condos in the 1930s.
According to Daily News, she bought the apartment in 1988, ordering a painstaking renovation, though holding onto some of the apartment's original period details.
The 5,100-square-foot, four-bedroom penthouse boasts two large entertainment spaces, which can accommodate 125 people.

The Louis XIV-inspired rooms - which include both a former ballroom and music room - have 23-foot ceilings, crystal chandeliers, and antique columns.
Joan used to host a grand Thanksgiving celebration every year at the lavish apartment, a tradition her daughter Melissa carried on last year.
'The best part of the evening is always the annual tradition where everyone has to stand up and say what they are thankful for,' said journalist Paula Froelich, when writing about the event for The Daily Beast.
But there was one caveat from Rivers, who reportedly said: 'No thanking me for being at this table or being invited! That’s bulls**t - not allowed!'

However, despite hosting her mother's holiday party there, Melissa has no desire to move into the luxurious apartment herself.
'Melissa has no interest in living in New York,' said a source close to the family. 'She’s got a son in school in L.A. She’s got ‘Fashion Police’ in L.A. She’s got a life in L.A.'
The apartment also comes equipped with a wood-paneled library, two outdoor terraces, a spacious master suite, a dining room, and a separate two-bedroom, two-bath guest apartment with its own living room, fireplace, and kitchen.

Joan gushed about her bedroom to NBC's Today in 2011, saying: 'Everybody says a woman's bedroom should look like a bordello. 'It's such a comfort, my bedroom. It is my main closet which, again, for a New Yorker, this is huge. For anybody else in America, it's like who cares?'
The comedienne - who received a posthumous Grammy Award Sunday for the audio book recording of her memoir, Diary Of A Mad Diva - lived there until her death in September, and seemed happy in the grand apartment.
Joan passed away unexpectedly while undergoing a routine endoscopy in September, and her daughter filed suit last month against the clinic where it was performed, claiming the clinic’s doctors were so busy taking cell phone pictures of their famous patient that they missed the moment her vital signs plummeted.
Joan did have a dispute with one of her neighbors, socialite Elizabeth Hazan, with the TV personality trying to have Hazan booted from the tony building after she allegedly defaulted on more than $200,000 in condo fees.
Hazan was able to return to the building after Joan's death.
