How long should I let this go on?

Ok, some background. I agreed to purchase a birkin off ebay from someone on the recommended seller's list. I paid a deposit through paypal, then sent the rest wire transfere. The same afternoon, I had meetings with attorneys again, (my ex of only 4 months died, and it had been a nightmare). To make a long story short, I realized that I shouldn't have been so hasty. I wrote and asked her if I could cancell. She was nice, and said that she understood, but the bag was in transit. And she would see what she could do. Now, she says that she will have to charge me for the Fedex charges, etc. I agreed that she should keep the deposit, (which wasn't a small deposit either). But, hasn't returned an email in a couple of days to tell me, when or how I will be refunded for the rest. So now, the question. How do I address this now?
 
I don't have anything!!! She never sent the bag...she's just keeping my money! I am a pretty patient person. For crying out loud...I'm still waiting on my podium order from last year...But, she said she'd refund the money...and now nothing!

Now, she said the bag was 'in transit' at the beginning? And it never arrived soooo, why are you paying for fedX charges.....I have some confusion?
 
wow, you sound reeeeeeeeeeeeeally patient... no FedEx tracking number, nothing? And it's been a couple of days? You can write her again and ask for tracking number, etc - maybe she legitimately has a reason for the delay? and then say that if you don't hear from her you're going to need to file some kind of dispute claim... It's tough because you paid for it via wire transfer...
 
im shocked that she didnt even give you a tracking number!!!

personally this is what i wld do - drop her a final ultimatum that you have not heard back from her for past few days & there is no bag to be seen... so if you dont hear back from her in next 24 hrs, you will have no choice but to report this to the police.

since you wired the money to her - you have information about her - like eg: her bank details & you have the transfer receipt + corresponding emails to prove your case with her.

I wld suggest that you bring this up to the relevant police dept ASAP if she doesnt reply (at least get it on records till you hear from her). You have been patient enough. Not replying back to your emails/disappearing for past few days IS NOT acceptable.

& check if she is still selling on ebay - if she is, get someone to write to her, if she replies to tt query, it obviously shows she is avoiding your emails.

As for the bag ... if the seller's on the recommended seller's list, I think the chance of something going wrong would be lesser.

At this stage, I do not agree that you should involve the police and get the seller to be on the defensive. The seller was very accomodating, in allowing you to cancel. She could have insisted that you follow through with your "intention to purchase" but she obviously was compassionate enough to revise a sale in your favour.

How about sending her another email, to clarify the following:-

How much of the deposit will she be deducting for the Fedex charges? Ask her to show you the Fedex invoice for the charges (it's a very fair request)? And ask when and how will she be making the refund.

I disagree a little bit. Not about the police bit, I agree that should be the ultimate resource and really only be used if the seller is completely unresponsive.

But legally (correct me if I am wrong) every sale can be cancelled within a certain number of days, the buyer has the right to change her mind. So yes, the seller was accomodating, but I don't see why she should keep the whole deposit, especially as it is higer than the FedEx charges.

It would only be fair that she deducts the FedEx charges from the deposit and then returns the whole amount minus actual expenses she had.

I would give the seller a couple more days - who knows what's happening on her end, perhaps she's sick or something - and then send a strong legal letter if possible.

Ok, an update, sort of. She wrote back yesterday and asked for my bank wire info. But, I just checked online. Nothing yet. I got to thinking back...I sent the wire on the 27th, I think she's had plenty of time to sort it out. And, I really don't mind giving her the deposit. It is a good amount, but, she may have missed a sale, so I just am going to consider that a cancellation fee. But, now really, she should wire back the rest of the money.
