HELP! Can H Spa fix this long, deep scratch/cut?

Makes sense. Would be very tragic if it happened at the seller's headquarter... on the selling photo from the owner this area is in the shadow and the picture quality not very good to begin with (see attached). So I would also not be surprised if it already happened at the owner's place. It is the only front picture (well and another one with background, but looking the same plus a bit of blur...). There I was hoping "it's just another owner with a bad phone and bad photo skills, but a good value bag". Will never buy another bag without well lit photos again. Even if I get the full refund quickly it's a waste of time and my funds are tied up when I could buy a different one. I start to see those high price purchases like stocks :lol:

If you know what to look for and blow up the image,
it is visible on the original photo, so there can be no suggestion that it happened after you received it.
The key words being 'if you know what to look for'.
Once you see the right hand end of the cut you can discern it stretching down to the left.
It was a very clever photo because if you just look at the photo carefully, as any prospective buy might,
there is not anything obvious to cause concern.
 
Agreed with @WhiteBus above, you can make it out in the original seller photo but you had to know where to look / what you are looking for. Unless they very explicitly noted this cut in their listing description of conditions they definitely weren’t honest with you. By the fact that they (most definitely deliberately) showed a photo that made it hard to see...I think not only is it a good idea to return and refund but it’s a good idea to be very cautious about this seller in the future.

You are definitely not overreacting and I wish you the best of luck OP.

That photo is making me uncomfortable....it looks like something could have been done to blur that area and the left side of the bag; I dont want or mean to accuse, but the rest of the bag is in focus. At the very least you can easily argue that the photo of that area was blurred.

Thank you! Yes, I agree about the cut being "kind of visible" once you know where to look for... I'm not dealing with the seller directly, but the platform. The moment someone buys a bag online, the (mostly private) seller sends it to their headquarters for authentification and check of the condition. When they find it conforms to both they will send the bag to the buyer... they charge for the shipping and authentification service.

I'm thinking the following: I'm based in the EU (live there, bag was shipped there) as well as the platform (which is a company). My invoice comes from the platform (not the private, individual seller of whom I have zero data apart from the country the bag was located in). So I have every right to return the item for a full refund due to the EU return policies for eCommerce (as long as I declare my withdrawal from the buying contract within 14 days of receipt and send the item back within another 14 days... but I will not wait that long. And you don't even need a reason for the return. Their whole return policy is trying to screw consumers over and strip them off their rights). I will definitely make a video of the re-boxing in case the company wants to play games. In the worst case I can always get a lawyer, but hope that it won't come to this and the company will do the right thing. I will keep you updated, thank you all for your support! :flowers:
 
Btw, the exact description of the item was "Hermès Birkin vintage black and gold bag 40cm. Some signs of wear but very well maintained". That is it... and classified in "good condition" by the seller and confirmed by the platform, whose definition of good condition is as follows:

"Good condition
An item in good condition is a second-hand item which has been worn and well maintained. If the item has defects, they must be mentioned in the description and visible in the photos.

Alterations mentioned in the description and/or visible in the photo. Slight wear to the material is accepted. No holes, tears, rust or odour."


I highlighted the critical text in red... well by now it is very easy to find out what company I'm dealing with...

I am sure you are taking the correct course of action.
It should have been picked up by the platform at the authentication/quality control stage.
Over the years I have fortunately had three potential purchases halted at that point.
We should be well-protected here in the EU by the Distance Selling Regulations.

Sorry that you are having to go through this, but hope it is resolved quickly.

You put the finger on it. I feel there was fudging that is not just the lighting.

Vestiaire is terrible! Their quality control is a joke and doesn’t even spot fakes when they have them in hand. I’ve had issues with them before.

Sorry to hear that and I agree about their quality control... Were your issues with them resolved in a satisfactorily way?

I bought a Goyard bag years ago which had a hotstamp of initials inside (again, undeclared and not pictured). Instead of asking me first they just sent it... They did give me the option for a full refund though. I kept it in the end as the deal was good and it was only inside. But their service didn't make me too happy. And yet I bought again and again... another time they mixed up shipments and instead of a clutch I received a dress. Took almost 2 more weeks to get the correct item. The main reason I went back to them is their sheer selection of items, the opportunity to make a good deal and I feel like the security with designer bags is slightly higher than with ebay.

Glad to hear that it worked out in the end despite the hassle. Of course no one should be dealing with these issues in the first place. Receiving a fake is even worse than my case.

Unfortunately no answer from them today. I emailed them today pretty much 24h after their last email yesterday. The content was basically a reminder to send me a return label and info on when someone is gonna pick it up (though I guess they expect me to carry it to the post myself...) and to please speed it up considering it is not a low value item and it is their team's fault for not informing me in advance about an obvious deviation from the description and condition... I hope they will reply tomorrow.
 
Finally some progress, I received a message with return shipping label and exact instructions, plus how to schedule a pickup. I'm glad it's progressing and will have a thorough packing video taken until after I seal the box...
