WTF? Ebay seller stole my picture

I'm not out to get anyone. I just want my pic out of that listing, to clear my name in case anyone assumes this listing is mine, make sure the TPF ppl know what is going on since many oh her listings were authenticated in TPF, and warn ppl against biding on this particular auction because the bag they see is not the bag they will receive.
 
I am selling my Lindy which I have in my possession which is absolutely authentic. That photo I found by doing a general google search of the word "lindy" and it came up under images unconnected to any website, nor did it have any indicia that would have led me to believe that anyone owned it. It appeared to be out there in the public domain and so I used it because it was a beautiful photo of a black Lindy similar to the one I have listed. I apologize if you are the owner of the photo as I had no idea. Perhaps you could have messaged me that the photo belonged to you before calling me a "scammer"and a "thief" and calling my items for sale "questionable" on TPF!

Hello Mimibag...I commend you for coming forward and shedding light on this matter. I would like to special mention our dear Perigord for keeping an open mind to give the members all the possible and potential scenarios as to what could have caused the utilization of other individual's picture.

However, you should also understand the frustration that OP felt. I would be upset and enraged too if I see one of my photos being used without permission. It is nothing short of stealing someone's personal property. But since online pictures become public properties, unless copyright protected, I have a reason to believe that you used it because it is published and no ownership is attached to it.

I hope that you and OP can work this out among yourselves.:flowers:

Thank you for the info Miyake0214. I am no expert on copyright law!! I'm just a mom who sells stuff I buy and no longer use on Ebay. I see so many sellers use photos from advertisements to head up their listings that i thought I would do the same as I take awful photos. Like I said I thought the photo was from an advertisement because it is such a beautiful photo. I sent the op an apology as well.
 
I am such a watermarking klutz... Must do a better job. This is a lesson to me.

I am a little confused by the seller's background and would like to know more. I see a gold Lindy that was sold on January 26 for $4,000...again on February 7 for $4,550...and again on March 3 for $4,999. All have the same images, and the date/craftsman stamps are identical.

This could be a rare case of several non-paying bidders, because I see no feedback for the seller or buyer for any of the bags. But I also see a Chanel sweater dress (same images) that was sold two times.

Perhaps the seller is astonishingly unlucky collecting after a sale. Or there could be other reasons.

At this point it is all conjecture, of course. No one has heard from the seller and I am trying to keep my comments measured until I learn more.

The gold Lindy sold to a nonpaying bidder once, to an international buyer once who wanted me to undervalue it and I would not, and then to it's third and final and very nice buyer. The Chanel sweater sold first to an international buyer who wanted me to undervalue it and then to a very nice buyer. In addition, I took all the photos of the tohu bohu scarf!
 
Mimibag: I learned something new today as well. Henceforth, I will be more careful with reposting pictures taken by somebody else either for amusement or endearment. I hope Eric Bana will not sue me.:p

I really have seen everything now...you stole her image and request a personal message about it.
 
U are not the only one as my pictures are also stolen which i have posted on bonanzle but never listed on ebay until someone was been kind and highlighted to me. Of course i was in total shock and frustrated. Have complained to ebay as well.
 
I just checked and this seller got scared so she switched the lindy pic on the ebay listing. So sorry about this I reported the seller.

I am the seller and I didn't "switch" any picture. I only removed the photo which I learned belongs to the op. The photos that are there now were always on the listing !!!

Thank you so much for the explanation. Because there was no feedback for the gold Lindy it seemed logical that it might have just been "bad luck" transactions. I appreciate you coming here to clear that up.
 
This is an Ebay matter and the seller and person who owns the photo can now resolve this privately. There is no proof that the bag is either authentic or counterfeit. A reminder to all that this kind of thing is an ebay issue and although the thread is instructive, it does not speak to the authenticity of the bag specifically.

The lesson is to please watermark all your photos!
