Thanks marnee and solid gold! I will definitely make sure this transaction is NOT cancelled and that eBay/Paypal are both notified once their offices open tomorrow morning. I cannot have this seller hold on to my money for much longer, and I sincerely hope no one else ends up buying from them ever again.

I honestly would probably cancel. With so many scams these days i'd be afraid that shady seller would send me something generic and i'd lose the money and item. But that's just my fear of ebay these days with so many shady people ruining it.
 
And the new listing doesn't have a reserve either!!!!

Make sure you do report this and the refund of your payment should have been immediate; that is so unprofessional of the seller.

I suspect that she's seeing if she can get more with the new listing, and if so, she'll refund the OP's money; if not, she'll send the bag. Basically she's trying to have her cake and eat it too.
 
As the other poster said at this point it's theft plain and simple as she has not refunded you and has said she has no intention of sending the item. It's a large amount and she needs to refund you ASAP, for all we know she's already taken your money out of PP and you could end up waiting 30 days or more for your refund. You really need to press this and I hope you get your full refund today without much more trouble.

question on the place where it says to post a question can't we all flood her auctions and description with question of why this bag is for sale when it's already been sold? wouldn't this help to stall the auction?

Sorry this is happening to you OP - you've already received great advice so I'd just like to add that I hope things work out for the best for you. Sellers like that need to be kicked off eBay!

Honestly! Isn't this insane!? I just hope the sellers plan to get more money is foiled and ends up with either a lower final price, or a non paying bidder.

And I've called Paypal today and spoke to someone who is looking after the case. I've pointed out that the seller not only took my money, but went ahead and listed the item again! The agent has made note of our emails through ebay, yes, including the now infamous "price is too low so I can't sell it to you" message. He says it's pretty clear what's happening here and that it should be resolved in a matter of days.

Here's hoping there aren't any delays in the investigation! I'm confident this will have a good outcome and hopefully, for all our sakes, sellers like this will cease to exist on ebay. Thank you thank you THANK YOU everyone. I can't tell you enough how encouraging it is to have TPF as my cheerleading squad through this mess :smooch:
 
It would almost be worth the non paying bidder strike to win her next auction and not pay.... Not saying you should do that but i wouldnt want that bag sold to anyone else until you had your money back im sure if you did it and explained it to ebay afterwords they would remove it
 
As it just happens, I'm now dealing with this garbage as well -- won a pair of Louboutin heels for the same price as they're now in store but I'm guessing that with her having to pay shipping and eBay fees, she's losing money so she sends me this message:

I am very sorry to inform you that this item is unavailable and out of stock. I have been out of the country for a few days, and a friend of mine was supposed to cancel the auction for these shoes and they never did. I am sincerly sorry to cancel on you like this. Please respond to ebay when you receive the "cancel transaction" notification. Once again, my apologies.

Well, you were clearly in the country today and you could've canceled it before I won. Also, I travel quite often and have been to 31 countries and had or could have found access to the internet in all of those instances - even when I was in the middle of the rainforest. In any case, the auction is your responsibility as a seller. I think what REALLY happened is that these shoes sold for less than you expected and you don't want to take a loss. Although I can understand that, it's still your fault -- you should've set a reserve price. I also sell on eBay and I've taken losses before but because I am bound by the rules of contract, and I happen to take my responsibilities seriously, I send those items to their rightful buyers. So - no, I won't agree to cancel the transaction and you're still liable for the seller fees on eBay -- 9% of $895 comes out to $80.55. If, however, the shoes miraculously appear, let me know and I'll pay for the shoes I won.


And I actually did pay just so I'd have the opportunity to leave feedback afterwards. Some people!!! When did eBay become so problematic?! I am having problems left and right whereas before I bought and sold and had ONE issue in like, three years.

Wow, does the crappola ever end on eBay? Never mind, I know the answer already.....

OP, I really wish you could get your bag, but I think you'll have to settle for a full refund. The real kick in the pants will be if eBay doesn't suspend or ban the seller
