Sharing a recent experience that might be helpful to others. In November, I came in to JFK from St. Barth via St. Maarten, I had spent €15800 at H and had some other incidental purchases. I was traveling with one family member (my sister).
I confirmed at the kiosk that I had goods to declare but interestingly enough, I did not get the dreaded X on my form. When I went to the immigration officer, he asked a few random questions about the travel and then asked if I had goods to declare. When I said yes, he seemed very surprised. He looked at the form and noted that I had check yes. He then ask what I purchased. I told him that we had each gotten a handbag and some scarves. He asked the value and I told him mine. He then said something along the lines that “there are 2 of you and you are just over the limit” but I noted that we each bought a handbag and scarves. At that point, he sent us on to an officer to pay. We arrived in the office and the sole officer was expecting some big flight and he did not want to deal with us. He asked another officer to walk us to the exit and speak to the agent there. The agent there had the choice to wave us through or charge the duty. She chose to charge the duty.

She looked at the receipt and assessed duty as follows: $1600 exemption, 3% for first $3000, then worked with us on the rest. She backed out the leather first (from the personal exemption and flat 3%), which was is usually 9%, then did the scarves, which were 3%, then calculated the residual at 9%...so total duty was approximately $650.

A couple of things to note. I agree with others, it is up to the agent and they can work with you as they see fit within the prescribed guidelines. You should always behonest and friendly. They do not want to convert euros so treat them like dollars. THey will not backout or recognize VAT.

The agent told us that she had nailed quite a few people that day, and even had given them a chance to come clean, but they didn’t...and they received HUGE fines. She reiterated that it is best to be honest as once you are flagged, you are on the “search list” for a very LONG time.

I would far rather have the piece of mind of declaring and pay the duty then fret about the consequences.

I always declare now too — then there isn’t anything to worry about! I personally would be humiliated if I didn’t declare and got caught. I cannot imagine coming home and telling my family that I cheated, got caught, lost my Global Entry status , and that every time in the future they traveled with me I would be searched upon re-entering the US! :wtf:

Just went through customs today and did mark off that we had over $800 in items but the agent simply waived us through. Would I be in the clear or could they still possibly send me some sort of bill? Is TSA being more lax due to the government shutdown perhaps?

I read in another forum that someone got a bill months later even though they were ok to go

They can't bill you if they don't know what you brought in. Duties are different on different items.

I think U.S. Customs only cares if you actually try to hide your purchases.
 
Just wondering how do they know if your wearing the item ? Say you buy a bag , throw the box out after your vat refund and wear it ? How would they know ? Cause when I was in Paris I saw a lot of people throwing boxes out and wearing ther bag . Just wondering

To me it’s not worth the risk. Custom officials are trained to observe what you are carrying and what you are wearing. Get caught and you are screwed. Get away with it and you have saved yourself a couple hundred dollars. Which is more important? Guess it’s up to the individual but I would rather declare and pay then spend the rest of my life being put on a list that requires my things being gone through with a fine tooth comb every time I leave the country and give up my Global Entry. Many times I have declared and gone through customs and just been waived through. I consider that a “bonus.” Other times I have paid the fees. All the times I know I have at the very least been honest and have nothing to hide.

I agree 100% thank god anytime I went shopping it was never more then a few hundred dollars . It was interesting to see in Paris , how people stashed and there boxes away before boarding plane.

If the customs officials of both countries communicate as other TPFers have discussed in this thread, then they can fine you even after you pass through customs.
 
So when I came back from Europe through EWR, my husband and I both declared that we have over $800 in purchases. I got very lucky on this trip and score a K Mini and a B35. We also had a few small items from H, 2 Chanel bags and few slgs, and DH got a pair of croc shoes from Ferragamo. We got the scary X at the kiosk and while going through customs the agent asked us a series of questions. What did we buy? What does DH do for a living? Do we have produce..? Did he buy a watch this trip? I joked and said that this was more of a shopping trip for me. Maybe it was bc I was 7 mos pregnant but the agent laughed and sent us on to an agent to calculate what we owed.

Bare in mind this was probably the first international flight that landed that morning. The agent he directed to asked the same questions and asked for receipts. I provided him with what I had on hand and I noticed he was a bit flustered. He then told me that normally we would have to pay but the cashier wasn’t there so we get a pass this time.

Over all it just depends on your luck that day

I will tell you how. You will tell the customs officer you bought it in NY - they will call the store in NY to verify. And if you are caught lying you will pay big time. That is just one example of how they verify.

Never understood why people who are wealthy enough to buy a birkin would be so cheap to evade paying the extra $1000 or so in taxes or duties.
