HELP! Designer Vault going bankrupt and they owe me 3k!

OMG. i am SO so sorry. :sad: This is so horrible.

Here's the response I got this morning. I'll update here again when I get more details.

Someone also mentioned on a FB post I made that we may be able to write off the loses on our taxes. I need to look into this.

I woke up still so upset this morning. I, like you, had plans for that money and I feel so taken advantage of and betrayed by a company I trusted. I wish they would make it right with as many people as they can. :sad:
Writing off the losses on your taxes may not help since the standard deduction was raised this year. Your itemized deductions have to be bigger than the standard deduction for you to get any benefit. Most people will no longer have enough deductions to make it worth itemizing.

Following this thread with great interest, and sending my best wishes for those who are owed money by Designer Vault. It’s incredible that the owner sold the company and within months the new owner filed for bankruptcy. There was “no change” form filed in the CA SOS since Dec 2017, which means the old owner must have sold the company sometime in the last year(?) it sounds very shady.

You all probably know this, but be sure to provide DV's counsel in writing your current contact info. He is supposed to provide that to the Court so that you can get onto the Court's official mailing list for this case.

The case will be filed in US Bankruptcy Court in San Diego.

I am so sorry that you all are going through this.

the wallet they said they're sending back hasnt been updated with fedex yet. not real confident that I'll get that back either. what a nightmare.
 
One more thought - if you have consigned bags to DV which you understand have not yet sold, I would include a description of them (style, color, year) and point out that the bags have not sold and are in the custody and control of DV and that you expect that the bags will be returned to you immediately.

Honestly, I don't know the procedure in this type of matter, but the bags on hand are there in consignment and should not be sold with the money going into the pot of DV's assets to be divided among creditors.
 
Also following this thread. I’m so sorry for everyone who has been affected by this.

I second Luvbolide’s post. Hopefully DV will return items to their rightful owners instead of selling them to pay off their debts. Can someone ask the DV counsel about this? Or maybe there is a lawyer here on tpf that can weigh in?
 
I posted earlier regarding my coco chanel bag that dv stiffed me on and I'm unclear how to proceed. Does dv's attorney provide a proof of claim form that we need to file with the court or do we contact San Diego Court when we get the case number? I would hire an attorney in this matter however my payout is $3000. and i'm afraid that between attorneys fees and the probability of losing, it would just be more money gone. Any advise would be appreciated.

Reading the other thread, I'm not actually sure if it was sold or if she just said it was in some emails to get people to stop bothering her.

My heart goes out to all who are impacted. I hope everyone receives their items and money due.

Is it like designer-vault and leather surgeon had a tie up? I remember sending a bag to them (designer-vault) and got a response from Hunter who is Garry’s son. Also when I got my bag repaired by LS, they included tons of designer-vault details to consign. Do you think contacting them may help?

Please share details if you get any on this. If they are/were in business together, I wouldn’t trust Leather Surgeons with my handbags anymore.

I’m now wary of consigning anything to other companies as well. This is so awful for those who trusted Designer Vault.

Designer-Vault used to advertise that they partnered with LS on their website. Since, their website is down, I pulled truncated cached copy from google. Here's the screenshot. Hope it helps

You can't sue them--once a company files for bankruptcy they are shielded from any proceedings outside of the bankruptcy court. You will just have to file a proof of claim. The bankruptcy trustee is supposed to notify creditors (that would be you) if there will be a distribution and when the deadline for filing claims is. The debtor (DV) is supposed to provide a list of their creditors/debts with their bankruptcy petition. You will want to make sure your name/info is on there so that you can be contacted about filing a proof of claim.
