It is in the grey area - why they technically aren't calling it Hermes, its very misleading, they clearly coping the styles, and even the names of the Hermes bags. Also I seriously doubt they are made in Canada as claimed - most likely made in China and shipped to Canada. Never shopped on Etsy, ethically I think they should ban this seller.

In my layperson opinion this is just a unbranded high quality custom bag in the kelly style. It’s not counterfeit or a replica in the sense that it has no HERMÈS foil stamp or branding to mislead the buyer (or future buyers if it’s resold).

Does Hermès legally pursue all bag makers who produce similar designs regardless of branding? I think most copyright laws state some small percentage of difference. This makers purportedly “beyond” statement paired with totally customized components probably fulfill the legal requirements.

I don’t think there’s any more fakes there than on eBay. At least on PoshMark if you purchase an item $500 or more it’s automatically authenticated in person at no charge.
*You can always get less expensive listings authenticated here on TPF prior to purchase. :graucho:
