I think you should be pro active about this & contact the CEO of Neiman Marcus. His name is
Geoffrey van Raemdonck & I would be diligent about pursing all avenues you can about this issue.
You have documented this very well & NM should want to make this right & by the way, the idea
of buying without having the opportunity to "return" an item in any category would not work for me AT ALL.
That is totally unacceptable. If you are good enough to make a purchase, you should be
good enough to have all the customer services awarded to all customers, IYKWIM
Even though this has been going on for a long period of time, the CEO needs to know how this
was all handled & the responses that you have received are offensive, IMO

The retail landscape has changed so much in even the past five years. It's depressing, but I feel that this is sort of a sign of the times. If nothing else, this should be a cautionary tale to all of us who make these kinds of purchases. :sad:

The executives that you have had contact with are obviously not helping you resolve your issue.
Personally think they were looking for you to go away & giving you the runaround so your issue would go away
In my opinion, the CEO needs to know all the details including the conversations that were so so inappropriate.
While the retail climate may be changing, there is no reason why the CEO should not be given the opportunity
to make this right in any capacity that he might be able to.
As a good will gesture to offer some form of compensation. Do you have a long term history with NM
not that should make a difference
Does American Express know this transaction may involve an item in which authenticity is being questioned?
 
I agree with others who have suggested looking into pursuing legal action at this point. I'm not sure exactly what this would look like, but they might simply settle and refund the bag to avoid bad press.

The problem today with retailers like Neiman Marcus and Nordstrom is that their shipping and receiving departments and many of the SAs have little to no knowledge identifying fake bags. They may also have thieves working there. It is more than likely that another "customer" purchased the authentic Fendi bag and then returned a super fake. This of course went undetected by the SAs and management...or so we think. Even if they later discovered it was a fake, would they pull it from the sales floor and inform the authorities? Or would they just pass it off the way it was passed off to them? Neimans executives are not the least bit concerned however because they believe time is on their side. Their lawyers and insurance company would argue that the time in between the sale and the fake discovery is too long and anything could have happened during that time. In any event, this situation is a disaster and every honest customer's worst nightmare. You are doing the right thing...letting it be known how this "reputable" department store has deceived and failed you. They just want you to go away quietly....NO! Hold their feet to the fire and make them pay! I only wish I could help!
 
I had an issue with a Fendi bag from Off Fifth many years back. I found out the same way as you. When I was selling it, I discovered it was a fake. It had been over a year since I bought the bag. It took many weeks while I waited for the manager to talk to the corporate office, but Off Fifth took it a back with a disclaimer that it would never knowingly sell me a fake. Mine was a little fabric bag that was less than $200, so I was prepared to just drop it if the store didn't refund me. But for your case, I second the small claims court suggestion. I think you said you're an attorney, shouldn't take too much time to figure it out. Hopefully once you file, Neiman's will decide it's not worth its in-house counsel's time to deal with it and refund you.

Yes, I believe you are right about being given the runaround in the hopes that I will simply go away. Unfortunately, the specific store from which I bought the bag is not my local store, and they don't really know me from Adam, which is not helping. I'm not a huge customer of the store, anyway. Most of my recent handbag purchases have been directly from the boutiques - if only I had started out that way, I wouldn't be in this pickle now. I have serious regrets about that!

American Express does not deal with these claims directly - I was referred to their insurer on the issue. The insurer was aware that the transaction involved an authenticity. However, two years is well beyond what they will handle, so I'm afraid that was that.

Thank you @fabuleux. There are a few courses of action that are open to me at this juncture regarding which I'm currently weighing the merits. I do understand what you're saying.

Thank you, @serenluv202 - I certainly appreciate it. It's been an unpleasant experience. I'm not the first to post on tPF about having been sold a fake from a major retailer, and I'm sure I won't be the last. Honestly, I always thought members who worried about this sort of thing happening were overreacting, so this is kind of karma. Anyway, it's definitely a situation of caveat emptor.

I recall one other poster having the same issue with an Alexander Wang bag, perhaps she could chime on how she resolved the issue.

Oh, I'd love to hear from that tPFer! I wonder if there's any chance she's still active? Yes, i recall a few instances in the past of members who'd had this kind of trouble - but I don't remember if they said how their cases were resolved or not.

A few years ago I received a fake Alexander Wang Rocco I ordered online from Saks. It was my first Rocco so I had no idea it was fake till another member here alerted me to it. So yes. It absolutely does happen.
It has also caused me to never again order expensive bags online. From then on I only purchase in person now.
