Just checked eBay AGB and the seller has to make sure, that the buyer receives the package - or is committed to do a refund --> the seller should have insured shipping or otherwise it is her risk

so @mbai you could totally reach out to eBay with your conflict (and maybe PayPal/ your credit card provider,...)

I did the same as you and only subsequently realised that it might have been an eBay transaction
That has not been confirmed

Nonetheless I am sure we all hope for a good resolution for mbai
and will take her unfortunate experience as a timely warning to be vigilant in all ways with distance purchasing.

For what I can see on the tracking, the package already processed at customs and on route to JFK but they never scanned it off the plane. They did a search at multiple locations but no luck. I'm less hopeful that it will turn up after the search. I'm starting to think about the possibilities to claim loss from the homeowner insurance but then again that's another fight that's not easy to win.

@WhiteBus @poopsie @Chaliya Thanks for your thoughtful considerations. And unfortunately I checked all the boxes that @poopsie had mentioned that not to do... The purchase was not made through eBay (I'm not sure why this post got reassigned in eBay, I posted on Hermes group initially) and was done through a wire transfer. As far as insurance goes, neither me or the seller had thought about that option because we never had issues with DHL before. Needlessly to say, I'm extremely naïve and blindsided in this situation and no doubt had learned my lesson the worst possible way. I guess the reason I haven't go after the seller to be responsible for this was because I wasn't ready to start this painful process. What used to be a good relationship can turn really ugly and I was mentally prepared for that. I'm working up to it after hearing you guys thought process though and hopefully I can some find some resolutions.
 
People frequently post stories in the eBay forum that have to do with other venues that they have purchased from including people who have purchased items from individuals or on Facebook. The post was most likely moved here because we give out a lot of timely advice about online purchases, first and foremost being NEVER PAY BY WIRE TRANSFER. I'm so sorry for your loss. I'm hoping DHL eventually finds it. They have been very reliable in my experience.
 
proper insurance is the responsibility of the seller.
She may be devastated but that's not your fault.
Worrying about your relationship with her should not even be a factor at this point
It's also not your fault that she can't afford to reimburse you the FULL amount. That's what INSURANCE is for. She's running a business ftlog and SHOULD know better
Why can't you make her pay? Did you pay cash/wire transfer instead of credit card?
Why would you just roll over and eat this substantial loss? Am I missing something?

yes, as an attorney said to me many years ago when I had a problem with a RE agent and said he was kinda like a friend - "that's over, this is business"
 
I'm so sorry this is happening to you. My only hope is that due to the pandemic, maybe it is just extremely late. Earlier this week, I worked a 10hr day and I usually check the mail on the way home; I got home close to 6:45PM and as I was nearing our mailbox, I saw the postal worker (who was probably contracted to help or new hired help as it wasn't my usual delivery guy!) still delivering mail and her trunk to her suv was open and FILLED to the brim of her vehicle, I felt really bad and didn't want to bug her so I decided to just drive on home and that I would check the mail the next day.
 
@mbai, I doubt there’s any way to make this experience much easier, but I had a friend who went through an experience where she had inadequate insurance and experienced a loss during a move. While she couldn’t recover the lost funds, she was able to deduct the lost amount on her taxes. It certainly didn’t eliminate the disappointment she experienced, but it did help soothe her feelings of being victimized to some degree. As she later said, it was better than having absolutely no recourse, even though the experience still left her feeling wounded.

Was the reseller a business?
