The letter she got has NOTHING to do with her being a former employee! It's the same shakedown letter - send us $300, $450, $975 or we can squeeze out of you or we'll sue you! - that they've already sent to HUNDREDS if not thousands of other sellers of Coach, Adidias, Rolex, Tiffany and more.

It's NOT about a former employee violating her employment terms, it's about a law firm shaking down Ebay sellers to collect money and scare them out of selling name brand items that may or may NOT be fake. And obviously in some cases the items have NOT been fake, like in the case of the seller who posted at the Clothing and Accessories Board, and probably the former Coach employee. Read the links.

Here's 25 pages by sellers of Adidas items that got the same basic letter (and yes, most of them probably were selling fakes but were stupid or greedy enough to buy them from Asia-based distributors thinking they were ok):

Hyacinth is correct. And if Coach is employing these bottom feeders, then Ms.Kim is absolutely doing the right thing by bringing it to the public eye. I realize there are some devoted Coachies here, but ignoring the facts presented isn't going to make this any less true, which was my point in my previous posts.

The letter refers to her selling counterfeit goods, if they had done their homework - which clearly they did not - they could have safely assumed the goods were indeed genuine.

It would appear they have their own criteria in terms of who they select to extort monies from - seems though this target is prepared to fight back.

Should be interesting.
 
It is interesting that initially at least, they are only looking to include class action members from the state of WA. I wonder if the defendant's attorneys will end up broadening that spectrum at all.
 
What bag is that supposed to be? I have never seen it before.

It's one of the Multi-Stripe Beach Totes, either the Large # 7427, or the Small # 7459, and GENUINE, from what I can see.

Coach really screwed the pooch this time.

If the problem is that an ex-employee is selling bags despite a signed contract forbidding her to do so, then why go after her for selling fakes? They might have a case for breach of contract. So why are they suing her for selling counterfeit Coach?

It seems as though whoever pulled the trigger on this lawsuit didn't do their homework. They were using the threat of a lawsuit to stop her from re-selling, but used the wrong threat. Her bags are probably real (if she really was an ex-employee), so I don't know if they can really get an enforcement from a judge for her to stop selling fakes.


I'm painfully careful when reading contracts of any sort, and I never knowingly signed anything like this when I was hired.


ETA: Funny thing, now that I'm thinking of it, I stopped in the store today to return a bag that I've had for a while without using and didn't realize that I got it after it was deleted, which meant it was a final sale for me. My manager said sorry I couldn't return, but I could always try to sell it!
 
ah and i did allude to that not being true after,

but i guess that was missed--

you can get fired if you are caught selling while you're employed there but afterwards, theres no saying.

but coach has a huge problem with you working there and using your discount to buy their products and go around and sell it for a profit.

I could be wrong. I did not read the contracts thoroughly as I should have, and was going off of what my manager told me. She specifically stated that Coach could sue me if I resold anything during OR after employment. I believed her, but it's not like that hasn't bit me in the butt before. ;)
 
when you sign the package of papers it's to release coach to look into your background, it's to sign your availability and the trickiest part is the actual application itself which I believe states that coach has the right to terminate you anytime without giving reason..but nothing of selling after..it does state that while you are there you adhere to their rules..again nothing after

and has anyone thought that going to court for something will tie them up? even if it isn't fake..
