Did you write to her and request that she use her own pictures? They do still reply nastily but it's worth a try. (Been there, done that!)

You can report the listing(s) to Etsy and they are required (by law) to remove them. It might take a day or 2 but I've had success.

The report is called DMCA and is to report infringement. I've successfully used it to get listings removed from Tradesy, Poshmark, Etsy and Ebay. (For ebay, I use a similar VeRO reporting form.)

D. Reporting Unauthorized Content. Etsy has great respect for intellectual property rights, and is committed to following appropriate legal procedures to remove infringing content from the Services. If content that you own or have rights to has been posted to the Services without your permission and you want it removed, please follow the steps listed in our Intellectual Property Policy. If Your Content is alleged to infringe another person’s intellectual property, we will take appropriate action, such as disabling it if we receive proper notice or terminating your account if you are found to be a repeat infringer. We’ll notify you if any of that happens.

Please use Etsy’s Reporting Form to provide notice of claimed infringement to Etsy’s Designated Agent under the DMCA and for other intellectual property claims: www.etsy.com/legal/ip/report. Using the form is the fastest way for us to address your claim.

That form walks you through the steps and it's totally worth it to send a message to thieving (and lazy) sellers.

Yes, first thing I did was to file a report with Etsy and I believe I've done it properly (but I will go check the links you share to make sure). I also told the seller that I will spread the word on tPF that she has a bad practice! I did not want other tPF members to deal with someone like her!

The seller had this nonchalant attitude when replying to my message (both on Mercari and on Etsy) and had no sense of remorse about it. I just told the seller to take down MY pictures and go take them herself. She was rather explaining why she was reselling it (none of my business other than hoping no one will actually buy the bag for $400!). I just cannot wrap my head around these behaviors!:mad::mad::mad:

Thankfully, she probably didn't have the guts to post on the same platform she purchased from, with MY photos. So she didn't post it on Mercari. Etsy listing is now removed. Maybe it's the seller that deactivated it.
 
If I was in a nasty mood and that happened to me, even though it's (probably!) not legally binding I would have sent her an email with a CC back to me and one of those "notify when recipient opens mail" features that said something like

"Since you have used my original photos illegally and WITHOUT my permission and also the time and effort I put into taking and posting them in my original listing, this email is to notify you that I feel that your use of my photos, time and effort, recognised under US law as my Intellectual Property, entitles me to two-thirds of the gross profit on any sale you make of the item that you originally bought from me. Your continued use of my intellectual property and/or selling of the (item description and Etsy listing title here) indicates your acceptance of these terms and could be held legally binding in a court of law or by Etsy's Legal Department".

Notice that I said "COULD be held legally binding", not "will" or "is". Hey, what do I know? :biggrin:

My son spend 2 years traveling the world on his motorcycle as a "photo journalist." That was his fancy way of averting the fact that he quit his job, sold his belongings and became a nomad!

His photos and videos were in multiple magazines and manufacturer websites of his sponsors.

He found people using his images for their own commercial endeavors and paid a relatively small amount to a lawyer to write a letter charging them $5K for their use of his work. He was able to collect from them.

Like much of the seller's history (Etsy: GutsyGirls, Ebay: debbieb208, and the following ebay suspended IDs:
gutsygirldebb-1, classiccottage7, marbrow_267), she still hasn't learned that she sells LOTS and LOTS of fakes, including the bang you've asked about.

ETA: Oops, I should have read ahead and ignored! But I agree with Hyacinth. Avoid GutsyGirls like the plague.
I'm bumping this post from several months ago because I found another ID of this long time fake seller and mixer. A search of any of these IDs pulls up an almost infinite number of posts of her fakes!

I'm surprised this seller is still allowed to sell on ebay. There have been over a dozen fakes removed in the last year!

This particular fake is interesting because on Poshmark, there's a beautiful clear picture of the creed. The same bag on ebay has a distant, angled and blurry creed photo, but you can tell it's the same serial number.

Poshmark may not remove the listing but it should be removed from ebay.

To show that the seller "seems" to be sneaky, I've included a pictures. By making the ebay listing's creed hard to see and read, she's hoping that buyers won't recognize it as the fake it is!

Please search the forum for this seller's ID, both on ebay AND on Poshmark. There have been a LOT of fakes and I don't know why ebay hasn't suspended her!

Previous posts go back at least until March, 2021 but shanahanlu_1974 continues to be allowed to remain on ebay even though ebay removed previous listings of fakes. The posts on the HOS aren't all-inclusive! (She's also on Etsy but Etsy doesn't respond to reports.)

This is today's fake, one that has been previously removed but has been relisted.

Mercari seller RosieBugsOutlet.

(She's also hrf111 on ebay but the fakes aren't listed on ebay. It appears she may know they're fake, thus not listing them on a site that may suspend her.)

The seller is a mixer.
