I bought a Bal bag, but it was missrepresented and in poor condition when I received it. :(
I want to get my money back, but she's not responsive. Please Help! :sad:

About a week ago, I bought a Balenciaga Flat messenger bag, it's a 2008 s/s bag, from ebay. The seller advertised the condition as "Pre-owned, condition is good, just shows normal wrinkles and signs of wear". I specifically asked her if there were rips or tears, and she said no just normal wrinkles from signs of use. So I proceeded with the transaction. I figured 2008, normal signs of wear, just wrinkles, great. So I paid $800 to her through Paypal. Then the bag arrives, and immediately as a tpfer, I'm excited, but I examine the bag and my heart sinks! :cry: There are so many things wrong!


First, the bag has a tear in the leather strap that is obvious! It's a rip where the stiching has come apart and the leather inside has ripped as well, making the strap seem fragile and that it'll break if I anything substantial in the bag. Second, the bag smells of something off. Cologne or something and seems "wet". Third, there seems to be a "handmade" hole on the strap that she made herself, because the hole looks completely uneven and different from the other premade holes on the strap. Forth, the hardware is completely scratched up, and she didn't reveal that. Lastly, the leather corners of the bag are completely raw.

I have posted pictures here to show the bag.

Through ebay, I try to be cordial and message her, that the bag seems wet, did she use any leather conditioner on it recently, if so what is it? I get no response.

I then proceed to tell her, through ebay messenges and email, that I'm disappointed because the bag is not as advertised. I specifically asked her if there were rips or tears and she said no. And the bag is not in good condition as advertised. And that I want to return it for a full refund. She ignores my ebay messenge and only responsed to my outside email account.

Through email, she says the bag was in good condition, how do i not know you did it yourself?! I was flabbergasted! At this response, how can a person with 100% feedback be so assuming and not willing to work with a customer she just sold a bag to? She then says, she used the money so a full refund is not possible. She said she can give me back $200 only or if I do sent it, she has to sell it and will give me whatever the bag sells for, and that it may take awhile for me to get any money back.

So I responded to her that same day and said that it doesn't seems fair. She made express statements and misrepresented the bag, and I did not agree to buy this bag in this condition. Since then, she has not responded. Two days have passed.

PLEASE HELP. What should I do?!??? My stomach is all twisted in a knot. :wtf: How can I get my money back?
She doesn't seem responsive for me to get my full refund or even partial now.
(A bag this condition is not even worth $500 because it needs to be sent to LMB for taking away the smell, sogginess, and fixing the strap.)

First off, SO sorry you had to go through this. I feel your pain! A few months back I bought a "NWOT" bag that was SO USED. It was awful!

Good news- You paid with PayPal, so you are in the driver's seat! I can't see any posted pictures from this thread that you mentioned (but I'm new so I just may have no idea how to see them!)

File an "Item significantly not as described" claim through PayPal. Upload those pictures you took. PayPal nearly always rules in favor of the buyer, and you will get ALL of your money back whether the seller likes it or not. Mention in your PayPal dispute description about having specifically asked about tears. It doesn't take too long to get an answer from PayPal, and they'll tell you to ship it back with delivery confirmation. Then at least you're only out return shipping!

I've done this before, so let me know if you have any questions, though I'm sure there are plenty of others on here that have been similarly burned.
 
When I filed my claim PayPal wouldn't let me upload photos, so I uploaded them to my photobucket account and then posted the link in the dispute area. Make sure you escalate your claim immediately, since your seller isn't cooperating, take your time and explain your case in detail. Something similar happened to me where I had specifically asked the seller if there were any scratches, stains or tears on the bag before bidding, she responded back that there were not so I bid and won. When I got the bag it had a significant damaged area on the front of the bag that she neglected to tell me about, so frustrating! I won my claim and received all my money back, except for what I paid to return the item. Don't return the bag until PayPal instructs you to do so and make sure you return ship with full insurance and signature confirmation since your item is over $250. Don't let the PO tell you you don't need both, you do!

Will paypal have access to all the ebay messages that went back and forth between us. Such as the one where I specifically asked about tears and rips and her response?

Or do I need to "forward" those to paypal.

THANKS SO MUCH!! I'm so glad I can turn to you experts in times like this. I felt so anxious helpless before. :shrugs: It's the worst feeling to be duped/scammed by a dishonest seller.
 
I'm not sure if they have direct access, but it wouldn't surprise me. If you mention them in your dispute, they might ask you to forward them, or they may just get hold of them themselves. As LindaP mentioned, you can also self-host some of this information and post links. Just screen shot those emails, save as a jpeg, and post online along with your pictures.
I would be careful putting some of that on photobucket or whatnot unless you can somehow make it "link only" rather than public access. If you have a gmail account, you can use Picasa web albums to do that.
And I agree about escalating to a claim asap.

What a disappointment. There are too many situations like this. I expect that is why ebay is perceived as more "buyer-friendly" these days. Based on what you have described, you should have no difficulty winning this claim. You will be asked to provide additional information. Take your time and document everything carefully. Do not close the dispute until everything has been resolved. It doesn't matter that the seller has spent the money. You will get the refund from Paypal. It is up to Paypal to collect it from the seller. Good luck.
 
Here's an update: So I called Paypal and they told me to open an ebay dispute because ebay is now overseeing disputes because the merchandise was bought through ebay. The paypal customer rep said that I can open a dispute through paypal but it takes longer to resolve the issue because the ebay dispute requires that the dispute be resolved within 7 days. She also said that Ebay owns Paypal so either way my dispute will be resolved. So I opened an ebay dispute today. I told her I have pictures, but she said they won't need them yet, they said to try to get open communication with the seller first and perhaps she'll own up and will provide a refund. Does this sound ok to you ladies?

I'll post more details as I get them, i hope it gets resolved soon!

Ebay fairly recently changed their policy regarding disputes going through Ebay rather than PayPal, but it's still buyer's choice which they'd like to go through. You've tried "open communication" and got accused of damaging the bag, so I'd say you're ready to open dispute. ;)
My PP dispute got resolved in way less than 7 days, so hopefully yours will too! You don't get a refund until the return shipment shows up as "delivered" though, just FYI.

Oh, and I can see the link/auction just fine. What a shame it didn't work out!

From what I have witnessed from recent posters, ebay dispute process has been moving along fairly quickly. You simply need to be very specific in your claim that the seller stated bag was in GOOD condition and did NOT disclose the following issues. If I were to file a dispute today, I would prefer it be w/ ebay, personally.
Do not correspond w/ the seller in any way except via ebay messaging.
 
Schientist and Ellie Mae, THANK YOU for sharing your advice and thoughts! Hearing examples of tpfers who dealt with this mess in the past really helps during these times. It's the pits right now. I feel like I'm clicking refresh every 10 minutes to see if I there is any word about this dispute. :weird:

Ladyisobel, the pics I took are too large in size (the jpeg exceeds the limit for uploading attachments.) So, I will try to compress the photos so that they are "smaller" and can be upoaded.

Open the dispute, you've already tried communicating with the seller! The quicker you open the quicker you can have this resolved. Just again be sure and state your case clearly. I think they do have access to the message through Ebay, you can mention them or cut and paste them and if they need you to forward they will let you know. They did not in my case though so I assumed they had access.

Good luck, I don't think you'll have any problem resolving your claim.
