OK so I just ordered from Yoox for the first time in my life (I am in CA) and they DID NOT charge tax. Since tax in my county is almost the highest in the USA at a wonderful 8.5% it made a pretty big difference... I was surprised and thought it was a mistake. Some people claim they charge tax in CA, others say they do not... has anybody been charged tax recently?

I haven't been charged. I ordered 2 wks ago. I checked my invoice from April 2010 and I was not charged tax then either.
 
Could it have something to do with orders that ship from Italy vs the US warehouse I wonder?

Of course, those of us that did not pay tax will certainly remember to report it and file with our state taxes :rolleyes:

Cal. Rev. & Tax. Cd. § 6203

[E]very retailer engaged in business in this state and making sales of
tangible personal property for storage, use, or other consumption in this state [. . .], shall, at the time of making the sales [. . .], collect the tax from the purchaser and give to the purchaser a receipt therefor in the manner and form prescribed by the board.

(c) "Retailer engaged in business in this state" specifically includes, but is not limited to, any of the following:

(5) (A) Any retailer entering into an agreement or agreements under which a person or persons in this state, for a commission or other consideration, directly or indirectly refer potential purchasers of tangible personal property to the retailer, whether by an Internet-based link or an Internet Web site, or otherwise.

I'm guessing it's that particular section that's making Yoox into a "retailer" who has to now collect tax. This went into effect in CA on 1/1/2013. There's about 9 or 10 states that have recently passed similar laws.
