What to do when you got ripped off by your jeweler?

I have recently purchased 0.90 tcw diamond stud earrings. Except for the clarity (VS2), the seller (jeweler from a local jewelry district shop) lied about everything (color, and size.) He told me they were G color, they turned out to be J/K. The size was off as well. They are not 0.90 tcw, but only 0.85 tcw. What to do when he refuses to refund? Is there a place to file a complaint?
 
Did you go back to the Jeweler and tell him what you discovered? Similar thing happend to me and I went back to the Jeweler and told him what the diamond appraiser said and the jeweler gave me a full refund since I did not feel comfortable buying any more diamonds from him.

Try first communicating with them and let him know how you feel and what you discovered. Then see if he will refund you, if not then I would definetely report him to BBB and get my lawyer involved. Perhaps a call from him might push the jeweler to refund you.
You can always call cc company and put a stop on payment.

The tcw is not far off but the color difference would upset me.
You received good advice. I would try to work it out with the jeweler first.
Hopefully you paid with a credit card because most offer some sort of buyer protection.
So sorry you are having to go through this.
 
Unfortunately, I did not use my credit card. It was all cash (as it was my grad present money.) Anyway, the jeweler is not registered at BBB so I do not think I can file a complaint with them. When I talked to the jeweler, he insisted that he sold me what he had said he did. I paid $85 for appraisal for the earrings so I know he is lying. Then he offered an "upgrade." Naturally, I declined. So far, I have only spoken to him on the phone. I will be driving back to him tomorrow to meet him in person (he does not know I am coming.) I just wanted to gather some advice and ideas what to tell him. They are LA jewelry district type of people and not a regular jewelry store so that is what concerned me regarding the refund.
 
The color is what upsets me the most as well. I could omit the size discrepancies as well as the fact that one of the earring is indeed SI1 instead of VS2. But I can't accept a color 4 grades too low from what was advertised!
 
Well, you can try to file a complaint with your state attorney general. But unfortunately you might get nothing from that. You can try a BBB complaint, and hope for the best. This is sadly going to be something where I think you lose your money and get stuck with something that was misrepresented without much recourse. Your other option is to lawyer up, but again, I don't see you getting much recourse from that either, besides losing more money.

It is a terrible idea to ever buy this kind of stuff with cash, esp without a full refund in writing without question, and it's also not a good idea to shop in jewelry districts without buying from a company you can research first. Many are legitimately good dealers, others are shiesters like this guy.

You can also take the jeweler to small claims court. It's not a difficult process and the threat might be all you need to obtain your refund

Thank you so much! You guys are awesome. I realized now that it was a mistake to pay with cash only (I never pay cash.) I will talk to him tomorrow and keep you updated.
