Hermes starts charging tax for sending to states with no store?

I used to be able to purchase my Hermes in a store and had them shipped to my state without tax.

Last week I went to a store, they said new law requires to charge the state tax even there’s no store in that state.

But today, my friend’s friend told me that she was able to purchase something have them shipped without tax. So I’m so confusing which one is true now.

Can someone confirm? TIA~~

That tax law is in place now. So if your state has a “sales tax” then you will be charged that sales tax if you ship to your state. However there are five states with no sales tax. Perhaps your friend has a home in one of those states?

My friend’s friend lives in the same state. Maybe her SA is just trying to please her?

Weird. I can’t imagine an SA doing that. Unless it was right around the time they were doing the changeover. Because once it’s in the system the SA has to ring up whatever tax pops up. So maybe she just got lucky, or maybe she just made the cutoff before they implemented the tax law.

Yea very weird, I went on MLK, my sa told me starting 1/1, the tax law kick in. But my friend went early this week, so weird

It may depend on what was purchased. It is true that shipping to a state without a store is now taxed, but if the goods are not taxed as a matter of course in that state, then no sales tax will be charged. In my state there is no tax on clothes and shoes, but there is tax on everything on bags, SLGs, jewelry, etc. So my jewelry purchases are taxed when I ship to my state, but my shoe purchases are not.

Very true. I recently purchased some items. My state does not have an Hermes. I did not have to pay sales tax but before I made my purchase, they had to check a list to see if my state was exempt as not all states with sales tax require the new law.

Yes, I believe not all states with sales tax have implemented the law yet. Here's a link to a chart showing when each state will start. Note the last column is the company, not individual consumers. ;)

I wonder how the new tax law affects bricks and mortars stores that ship items out of state. Klynnean’s link refers to online sales. If I go to the DC store and buy a bag and have it delivered to my house in Virginia, I wonder if I’ll pay sales tax. But if I buy a bag online from H.com and ship it to my house. I wonder they will add sales tax. Hmmm....

I understand that these are two different stores, but... the VCA Flagship in NYC used to ship my items to me (after I purchased in store), and I was not charged tax. The last time I did this (December 2018), I was charged tax. So I don't think purchasing in store makes a difference.

My SA is in Boston. I live in PA. I often buy in store and ship to my home. If I buy bags, jewelry, SLGs, scarves, etc. and ship it, my purchase is charged PA sales tax. If I carry it with me out of the store, I am charged MA sales tax. If I buy RTW or shoes and ship it home, my purchase is NOT charged sales tax because PA does not charge sales tax on clothes or shoes. If I would carry those same items with me out of the store, I would be charged MA sales tax.

H is not making a distinction between in-store and H.com purchases anymore. My SA was still getting used to the changes at the end of last month. In your case, you'd pay VA sales tax regardless of if you bought it at City Center in DC and shipped it home or purchased it at H.com. It no longer matters that H doesn't have a brick and mortar store in a state.

What if it's a phone order? For example, I call my SA in Boston and ask her to ship a pair of shoes to my PA address. Would that mean I wouldn't be charged for tax since it's a pair of shoes shipped to PA?

Correct. Since PA does not charge sales tax on shoes, your order of shoes mailed to you in PA would be tax free. Shipped orders are now subject to the destination's sales tax rules, regardless of whether the store has a physical presence in that state.

And regardless of whether you place the order online, over the phone, or in person.
Ah, thank you! I wasn't sure if it made a difference but good to know!

That's very helpful, thank you! IF I get offered a B/K/C in store again I'm going to ask them to ship it to DE, it'll be tax free!
