Fakes - please be careful

Inspired to me is not duplicating exactly. Interpretation of the law is perception.

I get that you can't claim ownership of a trench coat. However you can't put Burberry plaid inside one unless you are Burberry.

Wondering how many of these items were ordered with *wink wink* stamping Cartier, Tiffany, etc. vs non stamping. It was obvious what they are doing. Barely walking a fine line by a law that varies with who the plaintiff is.

Some of these are iconic pieces. VCA clover, no one has to duplicate that exactly. You could do smooth around the clovers instead of the beading. One could place the clovers right next to each other. The ones at the show were duplicated exactly. They purposely ripped off the design to try to fool the public would be my argument .

DBTY necklaces - those have been around for generations. Tiffany didn't come up with that idea. (I think that is their trademarked name?) Nothing special about placing diamonds on a necklace. I'm doubting Tiffany would fight that one. But their "Key' necklace? A key design can be changed - they don't have to look just exactly like Tiffany's

Many years ago there's was a case of a guy in Vegas that got busted for duplicating the burberry plaid in other colors. Not the same colors at all. He lost his stuff at customs & was found guilty. He said he was inspired. Didn't work. Will see if I can find these articles & link. Its been many years ago.

I think we will see more of this. The winners should be the design houses. They are the ones who came up with the idea.

Here's an interesting case from earlier this year. http://www.courts.ca.gov/opinions/documents/D061858.PDF The woman was busted at a trade show in Las Vegas in 2010. Shows how slow these case take to work through the system. Goes to show she brought stuff in & had it hidden in her room.
They can't catch everything. Sound like drug dealers business plan. Some we lose, we still get enough into the US to make it worth our time.

This is sickening. I just got burnt by a fake Cartier bracelet from evilbay that was so good that the Cartier store took it in for servicing. They only called me back like a week later to tell me that it was a fake. Down the line these fakes are going to find their way into the pre-owned market and buyers like me are going to get burnt paying lots of money for fakes :tdown:

Was the fake Cartier love bracelet you saw made from real gold and diamonds? I don't understand why the original designers aren't going after and seizing all these fakes? Surely it can't be good for their business and reputation.

Sure, it was real gold and real diamonds. I was comparing to mine, it's 4 diamonds YG Love.
It felt the same, looked the same, had the same finishing, shine, and etc. love is really a very basic bracelet, nothing too hard to copy... They make a wax copy and just reproduce them, I guess they repeat the Cartier process.

I'm sure those fakes would be found at the resellers/used market.

Not to hijack this thread. I should be able to able to get a refund, I posted in the ebay forum seeking some advice on how to go about this.

Ok back to topic! Inspired designs should be illegal too... it is infringement of copyright design. I thought some designers managed to sue against ASOS some years back for blatently ripping off their designs...
 
I have gone back and forth on this topic...sometimes I do feel its not cool at all to imitate designs. But then, there are companies like Cartier, which are just banking on their name and their quality starts to go down the s#itter and they can still charge as much as they want because they have their name established. Its frustrating. It would be nice if these companies just stayed ethical!
