The seller openly acknowledges that it's a replica!! Isn't that trademark infringement?!?!

and why is it that people selling fakes like to compare their price against retail price of the real thing - its like comparing apples and oranges.
what are the features that indicates its a fake? I actually couldn't really tell by the pictures posted so I asked the seller for additional pictures of the strap and bale.
