Shocking Tiffany Likeness!!!

I think I'm on the emailing list of every store in my city, but I'm really shocked at Kohl's Valentine's Day heart jewelry.

Kohl's heart jewelry, especially bracelets share an uncanning likeness to Tiffany's. If jewelry were people, I think Kohl's would be the evil one in the movie The Roommate or Single White Female. Take a look. I just can't believe it!

Unfortunately, a lot of stores create Tiffany inspired designs (e.g. Lord and Taylors has a heart tag bracelet and necklace). I distest inspired pieces. I think each store should try to create their own unique look.

Wow! You're right! It really does look like Tiffany. But I agree: this happens all the time in jewelry and seems to be widely accepted as long as it's not being promoted as the original.

The sad thing is that Kohl's can't be touched when it comes to copyright/IP law. Tiffany's didn't "invent" the bracelet. They came up with the design, what would make it counterfeit would be if it were stamped T&CO or whatever.

We studied a case in CivPro (civil procedure, Kohl knows what I'm talking about!) about how use of the design or idea is NOT copyright infringement, but use of the name is. It's like those fake handbags. You have a Chanel bag, all the interlocking CC's on the fake are interlocking SS's, and that's the ONLY difference. It sucks that, that is NOT infringement, but Chanel didn't "Invent" the handbag. They only slapped some CC's on it and called it a day.

It makes me sick, however the I do see the consumer need for a lower priced option of a designer good. But then you can go into, how it doesn't make you feel unique, etc, etc......But that's a whole nother can of worms!
