Scammed on eBay - Fake YSL Bag - Please Help!

Hi everyone,

Long post - I've attached pics to make up for it! Pics of fake bag and authenticity result.

I have become another eBay statistic. I purchased a YSL Cabas Baby Monogram bag from eBay last week. Seller claims she received it from her ex-husband after cheating on her (yeah, I know, I'm such a sucker). Anyway, I got the bag authenticated by a UK-based handbag reseller and authenticator called Handbag Clinic after I received the bag. They've got great reviews so I thought that they'd do a good, impartial job.

Surprise, surprise - they concluded that the bag was unauthentic.

I processed the return on eBay as 'Item not as described' (INAD) as the seller was trying to pass the bag off as authentic. After calling eBay to report the issue, they stated that INAD was not the most optimal option because that implies that I'd need to send the bag back to the seller. Given that the bag was fake, they said it may actually be illegal to send the bag anywhere. Anyways, they advised that the seller will still need to issue the refund given that the bag is fake and I've got proof that the bag's a fake. If seller refuses to refund after 8 days, they'll step in.

Here comes the problem - seller insists that the bag is authentic and refuses to issue a refund (shocker). She's accusing me of trying to scam HER and sending fake photos to the authenticator. She claims that she called eBay as well and they advised that she should not issue a refund until she receives the bag back. Now this conflicts with advice given to me. I don't want to send the bag back if I may be breaking the law. On top of that, I don't trust that she won't deliberately destroy the bag and claim that the bag was returned damaged to avoid issuing a refund.

I've since replied saying that I'd happily forward her the correspondence with the authenticator (including photos of the bag I sent) and close the case if she can provide me proof to support her claims of authenticity (such as a receipt...maybe she can ask her ex ha). Awaiting her response as of now.

Anyways, if there's any PFers who have gone through or witnessed similar experiences, would you be able to share tips on how best to handle the situation and what the most likely outcome will be? Appreciate any help I can get!
