I've purchased an excellent pre-owned chanel bag from the seller describing in her title..

" MINT!100% Auth CHANEL Black Caviar Flap Handbag, GHW " . (it was authenticated here)

Upon receiving and inspecting the purse i found numerous creases and internal cardboard bends/damage on the bottom of the purse. I reviewed the description and all the pictures that she took on Ebay and didn't find any pictures that showed that kind of usage/damage.

I contacted seller the same day I received the bag. I asked for refund since the damaged bottom was not disclosed BUT seller refused. Seller offer me $200 refund instead (which I don’t think would cover a chanel service/repair) and that she will only accept returns if proven not authentic. She also said this...

“I'm just letting you know that I have had one other buyer in the past try to file a claim against me because she did not like the condition and unfortunately, she lost the claim since I post tons of pictures and indicated that it is in preowned condition. It's up to you; “

BUT, what I BIN was listed as MINT and EXCELLENT PRE-OWNED CONDITION.. I am supposed to get what was listed and not with defect… I am really stressing out and haven’t been sleeping well for the last few days … Her listing is very misleading and if I knew this in the beginning, I wouldn’t have wasted $2200..

Lastnight, my husband help me file a dispute on paypal “ NOT AS DESCRIBE”. We were supposed to get an answer back from her. But TODAY I checked my paypal and found out “ A claims specialist is reviewing your case. “ Does this mean she escalates to a claim? And I notice that paypal didn’t required anymore action from me.. I know nothing about this stuff… Ladies, please.. i need your help... I don’t know how else to get my money if paypal sided with her… Seller seems to be knowledgeable about disputes.. I am willing to cover all fees but not keeping a bag w/ defect... Help..

Did you send pay pal pictures of the defect areas? That will help your claim. Odd that she would tell you this has happened to her before!

Since I haven't seen the flaw, I can't guess if you will win, but if the inner board is bent, I suspect you may win...

Once you upload the pics, it is up to her to resound to pay pal. If you win, you won't pay any more than return shipping fees.

that's why i was kind of worried that paypal didn't ask anymore information from me.. i thought that they would required more action were they would ask me for photos, letters etc.. then the specialist can review the case.. But in my case, they are now reviewing it without me giving any backup infos..weird.. i don't know how the seller did it.. But, i can post the pictures here.. please let me know what you guys think..

Not really. Just a written statement (on company letterhead) stating why the item received is Significantly Not As Described in the auction.

What? So if I buy a dirty beaten up bag that was listed as 'new and excellent condition', who am I supposed to take it to to get this letter?

Very glad to know this as I will NOT be purchasing anything over $500 now, just not worth taking the chance! I've been burned before by a seller that posted lots of pics but conveniently had them at angles that didn't show the damage to the bag.

To the OP, if you lose a paypal claim I think you should consider a credit card chargeback, if you paid that way.

You don't need a letter if what you're disputing is the condition, not the authenticity, of the bag.

ETA: You shouldn't wait for PP to ask you for info. You should always provide as much info--in the dispute and photos--as possible when opening the dispute.

OP:
Without seeing the listing and pictures of the bag you received, it's impossible to say whether or not the seller misrepresented the bag. If indeed there are wear signs, marks, flaws, whatever, then it's not a "mint" bag in "excellent condition." Mint means perfect. Did the seller describe these flaws and/or show them in the photos? If she did, then she sent a mixed signal by describing the bag as in "mint...excellent" while showing it has flaws. If she didn't describe or show the flaws in the listing, then she failed as a seller kuz sellers are supposed to disclose these flaws. If that's the case, that's what I would stress in my PP claim.

Did you paid via PayPal using a credit card? I hope you did. If PP fails you, you can return the bag to the seller (with signature confirmation and insured) and dispute the charge in your CC (file a chargeback).

OP: Are you in the US?

Apparently, for SNAD claims over $500 paypal now requires a letter from a third party.

You should call Paypal and find out what your next step is.

From where are you getting this information?

Wow, I had no idea! When did they start doing this and whose letterhead does it have to be on? That sounds like a bad move to me. Isn't Paypal supposed to be the one getting paid to make such decisions, not basing their decision on the letter of some unknown third party? I assume these letters are going to have to be paid for by the buyer like authentication letters...yet another cost for buyers. If not, who says the person writing it is any more credible than the person making the claim? Mon is on top of things like this, but all I can ask is "say it isn't true!!!!"

Here is what she was told by PayPal:

I escalated the dispute to a claim as Item Not As Described to Paypal and the seller has disputed my claims saying that the item was correctly described.

Paypal has advised that in order to return the item and obtain a refund I have to get it professionally viewed and appraised by a retailer or Chanel expert to confirm whether this is bag is believed to be in good condition because the item purchased for more than £500.

Sorry, I got my currencies mixed up - for her it was anything over £500.
