Got screwed wit a fake, what should I do ?

This is the first time that I am facing this kind of thing, ususually I am supercarfeul, but this time I saw the item thought these shoes could be practical and there were only a couple of minutes left so since they was rather "inexpensive" I put down a bid and won.
Since these are shoes used once the price didn't strike me as off.
I did pay via paypal right away and got delivered promptly but right away holding them in my hand I saw that the shoes were a cheap fake material was not even leather yuck.

Now what should I do I can't proove them to be fake I live in europe for info but don't have a shop carrying this brand in the area.
Ahhh I want to send them back and have the seller fully refund me including postage both ways but fear resistance, I could also just pretend I have never received them since and throw them away since there was tracking but no signature required.
But I have never done this and don't feel good about it since it's just untrue but I do want my money back and if I file snad I can't go back on it. and there is a huge chance I will never see my money.
Ahhh what a mess.
 
If you can live with the lie of not recieving, then that is an option, lt would not work for me, as l have a fear of Karma ....KWIM.
If it were me l would contact seller, also if they should be leather you could take photo's for pay pal. As its such a small amount you might strike lucky and get a refund.
You have to do what you can sleep at night with. Sorry not much help:(

I think it is best to file SNAD as the shoes are not made of leather and this particular style only ocmes in leather, right? Take lots of pictures and contact the seller and see that they have to say. If a refund is not possible then file the SNAD. Did you pay with CC?
 
Contact the seller, let them know you believe them to be fake (best to get them authenticated here on tPF....so you will be 100% sure). Tell the seller you want a refund. If they are not cooperative, then file a claim through ebay.

I totally agree, I can't do anything like that, but I was so mad that it did cross my mind , knowing that she has intentionally lied in her listing.
I did contact the seller but no answer yet...I know it's just about $120 and not an expensive bag but hey ...

in the long run it is never worth it to lie or cheat....

I definately agree as I said I just was so mad that I needed to let out steam.
I did contact the seller it's been more than 3 days, but no answer I am not surprised I will file SNAD tomorrow morning.

I am confused. Did you get shoes or a bag? Not that it really matters, but I thought you said shoes and now a bag?

I wouldn't lie. I know it can be a pain, but start following protocal
1. Contact the buyer
2. if they weren't work with you-File a dispute
3. Don't forget to escalate the dispute or you will for sure loose

If you file a dispute with ebay they seem to really side with the buyer and if you do not have hardly any SNADs that seems to help you win the case. However the burden off proof is now yours-Meaning they may ask you for it. Also I have had ebay pay for my shipping back. I opened the dipute on the phone, and they were very quick to help me.

Bear in mind that the seller may have intentionally sold you a fake, but may not have (if for example, she received the shoes as a gift and was unaware that they were counterfeit). That said the onus is ALWAYS on the seller not to sell fake goods, and you are entitled to your money back.
